Was just curious if anyone could help me with this. I'm wanting out of my Verizon contract I have 6 months left and noticed the customer agreement was updated on June 13 2013. Could I use this as a way out of my contract. Without a early termination fee? Have read it's possible just wasn't a 100% sure.

Chances are it will affect future contracts and renewals. Probably won't be able to get out of your current one because of it.
From my S-Off BadSeed DNA
Well sprint got into huge trouble about changing the etf about 1-2 years ago but that dealt with money. What was changed about it? And were you notified about the change
Sent from my HTC6435LVW using xda premium
Not sure what changed, been reading it over and over and am trying to find my original receipt to compare them. I had the customer agreement bookmarked and was checking randomly to see if it changes, but it does state that I have 60 days from the change date to agree and if not their would be no penalties. Atleast that's how I understood it. Just thought maybe someone else had got out of a contract this way before and had some insite. Will probably just call them and work my way thru the chain if command and try.
Sent from my HTC6435LVW using xda premium
Without even reading it I'd say no. Verizon has been excellent at not changing anything that would allow people out of their contract.
You have a link?
Spent about 2 hours on the phone earlier, the change was in reference to the 24 month upgrade change so no go. Even talked to 3 different supervisors. Guess I'll just pay the etf . thanks for the replys.

Just taking a wild guess at this that AOL means assumption of liability. Any advantages to your contract. How many lines is it? By advantages I'm meaning like you got the double data or still have a grandfathered line. With only six months left I'm guessing your ETF is just a couple hundred bucks.
I don't know if you're going to be changing to a different carrier but if that's something you will be doing in the future, someone with some connections might be able to use the ETF as a negotiation tool to get you some special discounts.
Might just look into this aol thing. Btw, I have 2 line double data. One line ends march 2014 the other November 2014

A couple of friends of mine were discussing this a while back, I don't know what really came of it but it might be worth a shot. Find a really rural out in the middle of nowhere spot that has no chance of having coverage and tell Verizon that you are moving there and that you would appreciate them letting you out of your contract unless they can provide service to you out there. Like I said, I don't know if it works, they were just talking about it and it was suggested.
If the contact terms apply to your account, they are obligated to let you out of your contract if you disagree with the terms. This is because the contract you signed originally is not what your new contact would be. By not saying anything you agree to the changes and it continues. A contract by definition protects you. If you don't agree with a change you can get out of it. If the change is for new contracts then it won't effect you and thus you cannot use this to your advantage. Hopefully this helps. It is applicable in any contract agreement.
Sent from my Nexus 7 using Tapatalk 4 Beta
The trick is to tell them you do not agree with the new contract terms, not that you want to cancel. If they ask if you want to cancel, you must say no, and reiterate that you are informing them that you do not agree with the new terms, also that you are recording the call for legal verification.
If you do not wish to cancel, but do not agree to the new terms, they can only allow you to continue under the old terms, which is illegal, or they can terminate your service. No ETF if they do it. Problem is that most reps you talk to will not be aware of the legal mechanics.

I'm sure Verizon has a huge legal team which writes and looks over it a million times before before it is put into effect.
If you do get out of it somehow, let us know! I'm jealous! :good:

I do believe your current address on the account has to be changed to that new area before that even becomes a possibility due to the fact that when you send an inquiry like that, Verizon sends a team to check the towers and signal strength in your primary location. Therefore your primary location is that of your home and I believe work is encompassed in this as well. I spend a month dealing with Verizon and their towers and 4G LTE dropping from my old Razr. They sent out 3 tickets in the coarse of a month to check towers.Yet only changed my phone and refused to let me out of my contract since there was no issue with the towers or signal strength in my area.

I live in the western portion of North Carolina and Sprint service here is terrible. When I had Sprint, while in town where service was supposed to be "best" my calls would drop like crazy. I could go into a store and service would go away completely. I had the same issue with AT&T. By far Verizon has the better network in my area. It's sad that we cannot get our BL unlocked but I remain hopeful. As per price, VZW is costly but people keep paying them so I'm sure they don't plan to change that anytime soon.
I used to work as a Verizon tech support agent with Verizon Online DSL which sucked hard. I had nothing to do with the phones, unfortunately. But yeah, I have been considering moving to sprint, but, alas, the Verizon Galaxy Nexus is just beyond the horizon for me. I must have it. I will soon leave this phone and forum and enjoy the freedom of an unlocked bootloader like I once had with my Samsung Fascinate. Oh how I miss that phone. But oh well. Its GNex for me.
Sent from my DROID X2 using xda premium
Around here, unless you live in a bigger city Sprint in Northern Indiana has really no coverage. Hell where I'm at Verizon barely has any, either. But then again neither does the Death Star or any other carrier. This area is a black hole for cellular signal. Although VZW is a little more costly as far as coverage you can't beat it. Now hardware on the other hand...
The other reason I left Sprint was because when I was married and the wife went on vacation to Maine several times a year Sprint had no coverage. Imagine my surprise when they tell me that I have an $800 bill because the signal was bouncing off Canadian towers. Granted from where her father lived I could throw a stone and hit Canada, she was still on US soil. Hence the other reason i switched
Sprint was the first carrier I ever had. The reception sucked and I had horrible service. I since moved through carriers and settled in with Verizon since I rarely go through patches where I lose service.
I too still receive the unlimited data since having the plan for so long. I have some friends and family who remain on Sprint and honestly, all I hear them do is complain. Perhaps they're chronic complainers, I don't know or perhaps its the area they use the phone in, but I don't hear many good things despite being in a fairly metropolitan area.
I also receive a 25% discount on the plan and accessories so that helps keep me a loyal customer. If they get rid of unlimited data, I'd possibly consider but so far Verizon seems to be the better of the two evils for me.
Im no legal wizard but I firmly believe if they changed all of us who are grandfathered in it would be breach of contract. We renewed our contracts and they decide to change it? Not only would I go elsewhere but id tell them where to shove their early termination fee. At $250 per month Id better be getting unlimited!

Doubtful that it would be breach of contract because they reserve the right to adjust as necessary. They litter their contracts with jargon and other nonsense so normal people have no interest to actually read it word for word and simply put their trust in them.
They simply adjust what needs to be adjusted and use whatever clause is in the contract that states they can make changes as necessary for the betterment of the network and its users. Even if that means throttling the highest data usage customers.
Chances are though they wouldn't out right get rid of it and force us all onto limited data contracts. They'd completely do away with it if they wanted and when it came time for renewing the contract, it simply would not be an option. I wouldn't worry about this happening though.

My sister wants to get this phone and she is still on the EVO 4G.
I told her she could just buy out her contract if she wants the full discount. It's only $50.00 (she's a few months out).
The Corporate Sprint store said she had to hand in her old EVO 4G to do the Buyout. She wants to keep it and sell it (she already got offered like $130.00 for it).
She called Sprint and she said she had to go to a Store to do it.
I thought you could just call up sprint, payoff contract and then buy and Sprint phone after full discount from any authorized dealer with a 2 year renewel.
And sell your old phone any old time you want.
I bought out of my contract no problem...they never asked for me to return anything back....besides that she paid for her of EVO with her money I would call again and speak to a diffrent service rep....

No point in calling again. That info is correct. Sprint modified the program. It is no longer being performed thru customer care. It is now being done in the stores and a buyback of the old device IS required. You were told correctly. Customer care can't offer this anymore. It must be done in the stores. This was done to reduce issues from the previous program.

A couple of internal docs regarding the new buy-out program were posted on Inside Sprint Now, which of course doesn't exist any more. Yes, starting in the second half of June early buy-outs are only supposed to be done through corp stores and yes, you have to turn in the phone that Sprint gave you in the previous upgrade cycle. The fee depends on the age of the current phone. It is a new program though, so you might still be able to do it the old way by calling customer service and without trading in your current phone, just depends on CSR's knowledge and luck.
Wow, just another reason to leave Sprint I guess. I think that's pretty dumb, as you essentially loose the money you paid for the device. Unless the money you paid to get the device is somehow subtracted from the price you pay to buy out the contract.
yeah this is bs, why would i pay off the rest of the fone just to turn in the fone and buy a new contract.... if sprint keeps this, they are gonna use alot of business....
You people are ridiculous....
How about you wait until your contract is up then? Then you can upgrade and keep your phone. If u want to upgrade early this is how you have to do it. Otherwise don't do it. Simple. Yet another reason to leave sprint? Lol. That sounds silly. Please explain to me how other providers run their buyout programs.

ok so i guess we're pretending that they didn't just take away the premire upgrades. you should be able to buy out the rest of your contract and not have to turn in the phone too, thats not a good deal, say you pay 165 to end your contract and then have to turn in a 500+ plus phone just do get a new one, might as well just pay the etf and keep the phone, u could actually make more money to get a new phone this way.

Just depends on the phone you have.
This is one specific program.. there are others
The push with buyback of the current phone in this specific program is the increased need for phone recycling, which sprint currently leads in.
The crying over contract changes that happened 6 months ago or more is just silly. Premium customers received one last upgrade to be used by end of year.

Roaming within the US is free for you, but it isn't for them, and that's they key. They tolerate some roaming, but when you roam a lot, you aren't worth it to them as a customer anymore because you're costing them more than you're paying them.

If you are unhappy and want out of a contract you agreed to, pay the ETF. It is the easiest and fastest method. Any other way is going to take more of your time and aggravation than what it is worth, pay the ETF and you are free to go where you want and you can be officially done.
What are the obvious reasons for leaving Verizon? It's a matter of time before unlimited data is cut from all carriers.

You signed a contract. You are legally obligated to to finish it out unless the contract is broken from the other side. If you are mad at Verizon for some reason like taking away unlimited, it is not a violation for them so you need to ride it out or pay the etf.

I live in the middle of an "extended network area" so I roam every day unless I travel for work. I have 4 phones on my plan, Verizon don't care.....
Oh only 10 a month off the ETF? Some do like so much for data and so much for voice but I guess they are all different lol.. How much is the ETF?
I pay the 11 some dollars a month for the TEP plan on my phones line, and I love the benefits. Since my first samsung moment dropped, I've probably had
3 replacement Samsung Moments
5 replacement EVO 4G's
5 replacement EVO 3D's
2 Replacement Blackberry Bold 9650's
I realize that's a lot of phones, but when you send out refurbed phones that were broken and then "repaired" what can you expect. I've honestly NEVER physically broken a phone to date (knock on wood), they've all suffered from software issues, or charging ports detaching etc.
Here's my question. I was talking to my friend last night, and he wants a new GS3 because of a superficial issue with his screen. I've had one or two phones replaced for some silly reasons, so I understand why he'd want a new one, but to date I've NEVER been charged for a phone replacement. They said it's a 150.00 fee for any kind of issues, and that's part of his TEP plan (He pays the 11.00 also).
Am I lucking out because I'm friends with all of the reps there? If there's a problem I walk into the store, ask for a replacement phone, they order one and I'm out of the store in 5 minutes and then the phones there tomorrow by 2pm. Can anyone chime in on this?

Even with the $10 added fee it's still cheaper than anyone else for unlimited data. It's not a big deal.
I see the fee as one for unlimited data - way cheaper for me than the other business models. So I'm willing to pay.
Unfortunately when you get less than 200kbps at best you still pay a premium data fee and who cares about unlimited data when your speeds are pathetic. My phone is basically useless unless I'm on WiFi. Sprint won't cancel your contract unless you're roaming excessively and costing them money.

We dish out 50.00 a month to sprint for that "premium data" fee lol. That's a lot of money we just give sprint for the hell of it imo.

I'm sorry but premium data is for all smart phones because they use data all the time.
Still cheaper than what anyone else offers.
Everyone that complains about spotted with sprint, didn't you check coverage before committing?
I have great coverage everywhere I go. Hence why I have Sprint.

A quick story about the fee being for smartphones. My daughter's EVO had a software issue that I couldn't fix so we went to the Sprint store and switched her temporarily to her old LG Optimus. The Rep was able to remove the $10 fee. So tell me how is this possible if you can still have a non 4g capable smartphone on the plan? I do agree though that it is cheaper than the alternatives.
No clue. I just know they add it to all smartphones whether they have 4g or not. As of over a year.
Last year the only android phone that didn't get the fee was the Samsung replenish which is a piece of crap of a phone.
Sprint changed the 4g fee in August 2010 to a premium data fee for Android, wp, and BB phones.
You must have gotten a good Rep then.

Yes, and the thousands of people with 4G / LTE phones who live in areas WITHOUT 4G / LTE are still forced to pay that 10.00 a month, what's right about that?
Thanks for your concern though, ironically between the ages 18 and 19 I worked at my local Kmart as a loss prevention associate, and shoes were always the easiest to catch.

He was not stealing the store policy was if ANY thing was wrong with your purchase they would exchange it. Needless to say they have gone out of business.

I wouldn't take moral advice on policies from people who void their warranties by rooting their phones. It's like taking financial advice from a hobo. However, yeah, doesn't surprise me that 1) they'd be easy to catch and 2) that people would steal shoes from that K-Mart. Aaaah, good times at K-Mart...miss the K-Cafe

If you pay for it you can do what ever you want with it.

The problem is I had decent coverage until I moved to a more urban area and now my coverage absolutely sucks.
Spent a half hour on the phone today with a "technical support" rep who was just reading off her computer how to update my profile and other pointless things. Trying to blame my poor speeds on my phone. She wanted me to take my phone to a repair center until I told her it can't be my phone because all four of my phones are just as bad. She finally told me she would pass it down to the service techs in my area and call when they figure something out. They keep blaming it on an outage, but it has been this bad for over a year.

there would also be a deductible for loss/theft, although I realize that didnt happen here.
Are you liable to pay the ETF if Sprint cancels your line due to roaming? I read a post on the Epic 4G Touch forum where someone said 50% of the people he knows that tried the PRL change to get out of contract had to pay the ETF.
I don't see how you would be responsible if they're the ones cancelling your two year agreement.
Also, I have 4 lines on my plan but only 1 of them needs to get out of contract. Will the roaming get just that line terminated or the entire account?
Thanks
Not that I know of. I've never seen them make u pay the ETF in that situation.

No, you are not liable if they terminate the contract.

If I have 4 lines on the account, do they terminate the single line or the entire account?
Thanks!
I've seen people in that situation where they just terminated the single line that was the problem. Now whether or not u could complain and say that you all have to go elsewhere because one got booted I don't know if they would help you or not.

Sprint should resolve this issue for you, would need to call their customer service line of course but by you signing an agreement with them staying that you would pay the termination fee also goes for them as well which states they wouldn't charge you the term fee if they were to break the contract. Also they would only cancel just your line since each number is actually on its own contact. Hope this helps
