o2 being unreasonable - MDA II, XDA II, 2060 ROM Development

I tried to explain to O2 that I needed to use my Orange Sim until my orange number was ported accross. They stuck their heals in and state that I have to pay the contract price up front. As i'm on O2 max this is going to cost £900.
I told them they were beinging unreasonable and that I should have been warned that the unit was latched when i sold it.
What can I do?

are not almost all phones sold by telephone companys locked ?
i mean otherwise why should they sell them cheaper ?
you could wait for somebody to make a unlock program for the xda2 like they did for the xda1

I tried to expalin the reason why I needed an unlocking code, but they wernt interested. This is my first time dealing with O2 and currently I am not impressed. They have terrible customer service compared to Orange. I am now considering taking the XDA II back and getting a unlatched unit.
Does anyone have a name of a good supplier?

While I agree that O2 customer service is abysmal by comparison with Orange (my provider for 12 years until 2 weeks ago), I don't think O2 are being unreasonable in trying to protect their investment in your XDA2. They've paid roughly half the cost of your shiny new machine, and they need to know they're gonna recoup that, by forcing you to pay your line rental up front.
You can't reasonably claim that they should have specifically made you aware of the lock they've applied to the unit. None of the phone operators in Britain has ever sold phones unlocked for contract-competitive prices, so to claim you're surprised your machine was locked sounds like you're just trying it on, IMHO. :roll:
Maybe you are, maybe you aren't, but put yourself in O2's shoes.

The last O2 phone I brought was a 9110 (BT CELLNET). This was a very expensive phone and unlocked. I thought it was only Orange that networked locked phones. If I had know it was locked I would not have signed up to O2 Max. I am not trying it on, I just wanted to use my Orange sim in the phone until my number was transferred and then I was planning on being on 02 full time.
However this has shown me that o2 have very bad customer service and I am reviewing my options. Should I spend~£2000 a year with a company like O2.
If I can find an unlatched XDA II I might buy that and stick with Orange.

yes i agree with u - after 3 weeks of trying to get a unlatching code of o2 iv been promised lots but no results so far despite having agreed to pay up my line rental...
by unlatching u o2 dont lose out as u are still under ur contract for 12 months, i wouldn't mind so much if their policy was consistent but its not as they have provided some ppl with codes - iv had a customer service provider go as far as saying that he could promise me they dont have the tech to provide this info.... what bull!!

I was told the same thing. I said that there were loads of people that:
1) were unlatched by paying £15.00 (no need to pay a year in advance)
2) had already got the unlatch codes.
She told me that she didn’t believe me as the technology to release would not be with O2 for another 2 weeks. I said check out the web, its full of people already unlatched and some firms were offering unlatched units.
I told her that O2 seem to have a problem with consistency. If you have rules about unlatching, fine, but make sure the whole of O2 sticks to these rules. It is clear that some departments within 02 are happy to unlatch, some aren’t. I think it all comes down to your service provider.

and it doesn't help as i think iv run up a very high phone bill as their customer service number costs a lot!
now i wish i had waited a bit rather than rushing out to get hold of this latest device, i think o2 realise they hav got a unique product in the uk which has already got a cult following - they kno most of us hav only gone for the contract option as we are loyal xda fans!
trust me when the xda 3 comes out im gonna wait for expansys to get the unlocked units rather than stay with o2...

I've found them very helpful. I just divert my old T-mobile number to my O2 one. O2 say they would allow the divert costs against my O2 bill, untill the t-mobile number is transferred.
A new number might be good, it would stop all those young women ringing me up all day.
I was in Orange yesterday and they said they will be doing the XDAII in the new year, no date set.

i phoned o2 customer services today AGAIN and went to the complaints department & told the lady who answered about the difficulty & inconsistency iv faced from them regarding getting a unlatch code for the xda 2, to which she promtly gave me a speech on
1. how they didnt have the tech
&
2.its their own product so they wont unlock it
i explained to her on how ive been told so many different things regarding this and if she looked at my records it would or should show this, she then said il put u through to some1 u talked to b4 & as i answered the line a lady said oh hello, iv got the unlock code u requested plz write it down - which i did....
she forgot to charge me the line rental upfront & the fee! he he he....
so much for not having the technology!!
i suggest all u ppl who want it to keep calling in and requesting your code the more customer service advisors you talk to the more likely it is that one of them will get back to you.

Well quite frankly there's been a very long discussion on the 'locking' issue for years. The idea _was_ that they give you a subsidised phone for signing up, and at the end of the contract you have to come back to them. Thus the subsidy is spread over potentially TWO contract periods.
With the price of phones droping through the floor in just one contract period this is no longer the case.
The single contract period you are tied to more than covers the subsidy on the phone. And the counter argument is usually that u may default on the payments.
In reality its all about commisions and figures. Up front payment cost them less in theory and looks better on paper.
Providers such as virgin will give you the unlock code for FREE.
In the states T-Mobile will give you the unlock code for FREE in several states.
I personally wouldnt touch O2 with a barge poll. Their customer service _used_ to be the best. Its now the worst.
Their radio service (reception, handover ESPECIALLY etc) used to be next best to vodaphone, in my opinion it is now the worst!
If you are prepared to cancel your O2 max tariff, then threaten them with it. Dont bother with the complaints department.. call sales and say u got this tariff and you want to cancell it all, you've had enough.. thats what i usually do [for my friends and collegues]! They'll panic and ask why.... you'll probably get your unlock code pretty quick since u have a pretty valid argument!

I did get this sorted.
I went back to the shop that I brought it from and got a refund. I then setup a new account on the lowest O2 tariff. I then phoned O2, spoke to a different department who charged me £15.00 to unlatch it. (didnt have to pay one year in advance)
I am now running on Orange and due to the greif O2 gave me, I will not be returing.
My only out standing issue is setting up MMS on Orange. Orange have been very helpfull, but they do not have settings for the XDAII

Reselling of used XDAs as new units in Ireland?

Hi all..I recently bought an XDA from an O2 outlet here in Ireland which I subsequently sent back due to speaker problems. Having waited two days for my replacement XDA, (in the interim I was given a Nokia 5110 as a substitute phone, I'm sure they got it out of a musuem..) I finally picked it up yesterday. The retailer told me it was a brand new phone and that it had come out of a sealed box. When I picked up the phone I noticed marks on the top of the aerial consistent with a fall or even with someone nibbling on it! I pointed this out to the retailer and was assured again that the phone was brand new. Giving the benefit of the doubt I brought the phone home, hooked it up to the PC and went to adjust the memory allocation as I was gonna transfer a large number of mp3s to it. Now the XDA I originally bought had 64MB RAM, the unit I was given as its replacement had 32MB RAM - so much for it being a brand new phone! Also the battery took less than 2 hours to fully charge - on my original XDA the initial charge took approx 4 hours with subsequent recharges taking about 2 hours, the same length of time my supposedly "new" XDA took to fully charge on what should have been it's initial charge.
At this point something a friend said with regard to technology popped into my head, call it paranoia but he is fully convinced that Ireland receives the rejects, previously repaired, or just downright faulty items of technology where they are pawned off as being brand new. My experience with this XDA seems to bear it out. I rang the O2 retailer back and informed them that the phone I received was not new and when I explained my reasons why, I was told that the phone was probably a new one alright but that it had just been sitting in its box in a shop and not sold, hence the 32MB rather than 64MB version I was given. It didn't explain the marks around the aerial or why the initial charge took only as long as a phone that's been in use before to charge.
Am I being paranoid here or are companies chancing their arm by sending units that are technically second hand to Ireland (or other countries for that matter) for resale as new units? Does anyone else have a similiar experience, not necessarily with the XDA but with other top of the range (and expensive!) products, technological or otherwise?
Personally I'd take it back and tell them where to stick it....
Even if it is brand new... you bought a 64mb XDA...
It does sound rather fishy though... I think you've got enough reason to be 'paranoid'.
ask them how a brand new XDA can have only 32mb of RAM... I doubt they'll be able to give you that answer...
I've heard on various occasions companies such as dixons selling 'brand new' hardware (computers in one instance) where the customer brought it home to find the previous owners information including credit card number and other sensitive stuff...
Its not necessarily O2 that are screwing you over... it could be their manager or area manager that’s trying to cut a little from their budget...
either way that phone certainly doesn't sound 'brand' new.... probably someone’s reject that took it back last year.

I had the exact same thing from O2 as well, you might have my old phone, I bought a 32mb one but the screen was scatched so they excahnged it again for another crap one, so I rang O2 UK and told them my worries and I got one sent fromt he UK, perfect and no worries at all. Its cheaper in the UK aswell. You are legally entitled to a full refund if it does not meet the standards you expected and was told about "not fit for the purpose it was sold" is the lawyers talk!! I spoke to a mate who works for O2 in Limerick (head office) and told me that they do actually refurb the phones. for returns etc. so I would demand a brand new one with 64mb and threaten them with vodafone or metior that will scare them!!

Just to update you on my phone situation...having been told that my replacement XDA was a new unit I tried a few things to prove/disprove this...I backed up my calendar and contact info using Permanent Save and when I hit OK it backed up my info but it also restored the previously stored info on the phone, which, if as alleged, this phone was new then there should have been no such info already on the phone. Not to my surprise when I went into my contacts there were names and numbers that I did not recognise. I even have the home number of the individual who previously owned my phone! So what I'm wondering now is what to do next, who can I complain to and what will O2 do to compensate me for their mistake?
Also the retailer from whom I bought the phone left a voice message saying they have a brand new 64MB XDA waiting for me instore. It will be interesting to see if in fact the phone is brand new and not a refurb as Gary says is the norm for O2. Cheers for your tale Gary, I was contemplating getting a refund but I love my XDA and hopefully I'll have no problems with this next unit. Will keep you posted.

Just to let you know the 32Mb model was released early, and was replaced by the 64mb model. There was an offer for o2 staff, including family and friends to purchase the 32mb xda for 99 pounds ( i did !)
I also recall that the o2 shops had a limited supply of 32mb xda (advertised as reconditioned) which they were selling for 99 pounds.
You may have got one of these phones. It may have been a genuine mistake from the store. However, they cannot give you a 32mb model in exchange for a 64mb model.

Titan Down! and back up again

Ok so my Titan decided to die today, No warning whatsoever, The screen would not light up and the battery drained rapidly heating up the rear casing to a dangerous level, Not a happy puppy, Due for collection on Weds to be repaired at HTC Huntington, The thing is I do not have proof of purchase as it was bought on ebay and the IMEI codes on the device and box do not match, HTC phoned just now querying the IMEI that I gave saying it was not a valid one for the Titan, Am beginning to wonder if they will now say it is beyond repair or that I will have to foot the repair bill due to no proof of purchase etc, Oh well back to my trusty HD2 for now, So long Titan, It's been emotional........
If you want a new phone you should go to a operator, you pay 20 € more but then you have even a warranty for this .
If my Titan gets stolen within 1 year, I get a new one for free ^^

If you got this off ebay did you contact the seller about imei number issue ''IMEI that I gave saying it was not a valid one'' if there is something wrong then you can try for a paypal resolution if the seller cant give you a good reason for this wrong imei number. Worth thinking about ?

Thanks, I did find out from the seller that the phone had already been a replacement for his original Titan, Makes me wonder if it was a repaired/returned handset,Was meant to be the replacement I received, Its too late now to go for pay pal claim as I bought it early Jan and that normally takes a while to get refund etc, It is currently at HTC repair centre and hopefully being sorted, I haven't heard anymore from them and fingers crossed all will be fine, Using a HD7 currently and the screen seems so small lol
Got my Titan back today, Not bad going seeing as it was picked up last Wednesday 29th, Looking at the repair sheet they basically replaced : FRU-SUB ASSY,SONY,Black,LCM+Touch Window, Generic,L Sponge,P-Sensor,Poron,ETY PCBA-MAIN BOARD with SKU_ID,band 1,5,8,Regional_ID.......? lol and I now have a new IMEI number , In other words they replaced the lot, Happy that I now have it back, Lets hope this one stands the test of time, Thanks for comments and advice.

Mine is currently in Hong Kong because of the update issue. And I'm from the Philippines. Shipping costed a lot. OS just won't update and getting different errors. It was basically brand new. In fairness htc customer service is very good. Someone from Hong Kong called me yesterday and asked what the issue was. Also htc Philippines keeps on calling me for updates Hope they get it fixed or just give me a new one.
Edit: My phone is still stuck in HK. They won't send it back unless I send them the shipping cost. It's in freakin' HKD. How the hell am I going to send them the money? I mean I have the money, just don't know how. Why the hell couldn't they just send the damn phone to any of their retail stores here in the philippines and I'll give them the money. I'm so tired of going back and forth with them I might just give up. They can have the ****in' phone and I'll just start a hate campaign against them. Ironic since I have been a supproter ever since and I have actually convinced a lot in my office to use HTC phones. Really pissed off! Is there someone like Steve Jobs in HTC? Heard he did things for Apple customers out of the ordinary. No wonder they have such loyal fans.
Must admit on both occasions I have had to send HD2 and Titan back I have been very pleased with the repair service and comms and how quickly they dealt with the problems, No doubt thats not the case for everyone, I guess I have been lucky, best of luck and hope you soon get your Titan sorted soon.

Vodafone

Been using my I9300 for a few days now and noticed the signal is crap.
I never had an issue on O2 and it's not the phone as my dad's signal is the same with Vodafone on the I9000.
I spoke to the Carphone Warehouse and they said I can't return the handset within the 14 days as I have used it and made calls... but I thought the UK statutory rights says you can return goods within 28 days if you feel it's not fit for purpose? So as I am constantly out if signal the phones primary function of being a phone makes it not fit for purpose in my opinion.
They said to take it to a store where they can do a signal comparison and move me back to O2 if Vodafone agree, but I can't imagine Vodafone would happily sit back and let a customer go to a competitor during contract?
I'm pretty sure TCW can't block my statutory consumer rights even by contract, so should be able to return the phone so I can go to O2 and get the I9300 through them instead?

Strange that I am on Vodafone and my gf is on o2. I find voda to have considerable more signal than o2 on 75% of the time.

You are absolutely right mate, I got my Xperia play which was a decent phone a year ago and it was on Vodafone. Signal was so terrible that i couldn't bare with it no more. So i went back to phones4u quite angry as I was and I told them because I’m unable to access the internet through the network on my phone, which indeed is one of the primarily function of smartphones today, this contract to me is now void and I’m happy to take it to a legal level if you are not willing to cancel the contract which follows "1gb internet access" meaning I could use it. The guy started saying **** about how the 14day return policy has been removed and as the manager came to see I told him and he told me he is happy to cancel the contract as a signal issue is seen as a faulty and a faulty product has to be replaced or exchanged. I get NO signal almost everywhere. They have to do something otherwise I just have a clever stand alone device with no internet connection!
Sure I'll get it sorted though, I have quite some skill usually with this kind of thing.

No it has to actually be not fit not you feeling its not . Though usually saying i am returning this phone under SOGA as its not fit for purpose works .
Plus CPW leaflet you got with the bill should state within 14 days . If you find their is poor reception where it matters most . Return the phone to us and we will find you a network that works where you live .Simple .
Two points one check that you get a good signal away from home if not that points to the phone being faulty .If its just bad in one location then its the network you are using .

If you bought the contract from CPW i suggest you check on this signal and return within 14 days for another network .Its sat right in front of my eyes on the paper work CPW gave me yesterday .
CPW are the seller of the contract not Vodafone and that's where i would direct my attentions .
But as i said one phone is faulty or two you just get bad reception from that network .Evidence that the phone fails in other areas with a strong signal is evidence of a phone fault .
Trading Standards at your local council will be worth a call as may a look or question at moneysavingexpert.com ( FORUM mobile phones section )regarding your rights .

[Q] Followed all rules and still didn't get unlock code...need help

Hello, I followed all the rules for my carrier (t-mobile), paid phone in full, bill in full, had service for 40+ days of active service and I have all the paperwork to prove it. After going in circles they finally sent me a email saying they are "unsuccessful in obtaining an unlock code for the given IMEI” after taking picture to prove that the IMEI is the correct one for the phone.
I contacted my bank (USAA) and told them what happened and they said if I could prove it, I had a valid claim. I sent them all the phone records, and emails. Email was where most of the clear proof was because of messages from t-mobile verifying I had done my part.
The bank tried to contact t-mobile and gave them 60 days to respond and they refused to respond to my bank. So the bank reversed the charges for the phone. Then t-mobile without hesitation sent a letter to Equifax, TransUnion, and Experian saying I didn’t pay my bill and creating a bill for the phone and sent it to collections. I’m still working on how to get legal help.
But in the meantime, I have a company taking advantage of their power and unjustifiably ruing my credit while I have a phone I can’t use for anything but a paper weight.
So can someone help me unlock this my phone?
I can provide all the proof I provided the bank for verification that I did everything I was suppose to do: purchased phone/paid if full, paid all phone bill and had uninterupted service for over 40 days, and made multiple attempts with t-mobile to get the phone unlocked just to have them tell me in the end....sorry we can’t find your unlock code.
Side note: Before it got to this point, I actually tried to cancel the service and return the phone 28 days after signing up for service. They said they would only refund the phone after I think 15 or 20 days. But I had been working with their tech support troubleshooting the phone and swapping sim cards to figure out why I didn’t have service anywhere in my neighborhood during that time. It had been less than 2 weeks since the last sim swap while trying to work with them. All they were doing was buying time so I could not return a phone I paid $500+ for at the time.
I got another piece of information from another forum that was a little late. Some customers of t-mobile that were aware of the problem t-mobile and other carriers were giving customers with unlocking their phone found the easiest way to get the unlock code was to tell the carrier they were going to use the phone overseas. Then the carrier wouldn’t think they were trying to switch to another service. Once they verified the customer met all the other requirements, they gave them the code and then they switched carriers.
But that information came to me too late. Plus, since I did everything I was supposed to do, why should I have to lie? Especially when people who know how to unlock phones are hesitant to do it. But carriers are still taking advantage of customers.

The board rules also state the reason why, and I have proof that I legally purchased the phone, I have a copy of the t-mobile agreement which states that I need uninterrupted service for 40 or more days before eligible for unlock, and as far as the rights agreement between the user and the carrier, the carrier indirectly violated their own agreement by pretending they could not find the unlock code after I followed all the rules requested to receive the unlock code. That is why USAA reversed the charges after getting all the verification and giving t-mobile a opportunity to respond.
So t-mobile took the path of least resistance. Instead of battling it out legally over the "terms of service" with my bank, they just defrauded my credit and left me to fight to get it fixed which has become a bigger financial problem than the cost of the phone.
So the request was with the "rules" in mind. Which is why I included in the post that I can provide all legal evidence that the phone was legally purchased, the carrier breached their own agreement, and I've done everything I know possible to correct the problem.
Another reference to the rules: you can verify ownership along with email communication's with t-mobile through full header/footer copies of emails which is what the bank did. And the bank statements from the bank as well as t-mobile in store purchase receipt verify purchase.
I don't see why you post as if you cannot understand why I am even reaching out to online communities after reading my original post.

However, if you're ultimately unable to unlock the handset (or just want a change), the 1st gen Moto G might be a good option for a replacement for an i9100 (or any other S2). Buy it unlocked and sim-free not from a carrier or one of their partners/resellers.
Stock rom or custom rom. It is an affordable handset with very decent specs.

Metro Dirty Unlock practices , after thier insurance replacement phone telling me another 189 days till I can unlock

Ok, so I have been a Metro cistomer for over a year and while they are the cheapest here you surely get what you pay for. The support is aweful. Well twi weeks ago I cracked my screen and called their insurance and got a replacement. Welm yoday I call Metro and they refused to unlock it. i asked to soeak with manager after manager and eCh one told me they could not unlock it because it is a new phone and has to be on the network for 180 days i was like Boyght this phone over a year ago, this is a replace through insurance. How dies that reset my 180 days. I am so angry right now and Metro is no help How are they able yo keep me network restricted after being with them for that long. To use an insurance replacement to lock me in for another 189 days. Any advice would be great.

Unlocking is a per device basis, it seems.
Every time you get a new device from them, that device has to be on their network for a specific amount of time before they allow you to take it over to a new carrier if you wanted to.
This insures that you have to use their service, and therefore pay them, for at least another 6 months. It prevents people from getting good phones for cheap or maybe free then jumping ship to a different carrier before they can at least recoup whatever they lost on the phone. Same way with contract carriers you can get phones at a major discount if you agree to be locked into a long term contract. (Eg. my first smartphone retailed for $600 back in 2011, but the family member that paid my bill at the time only spent $200 after rebate by agreeing to have my line on a 2 year contract)
By allowing a replacement phone to be unlocked right off bat that means someone considering switching carriers can intentionally break their device, get it replaced on insurance, then jump to a different carrier with a brand new device and leave the old carrier eating the cost of the replacement.
They are probably within their right to do so, as it probably is in the fine print of their Unlocking Policy, or written in hard to understand yet still valid legalese.
It's kind of sucky, but it's understandable why when so many people are looking for ways to get one over and exploit loopholes and stuff.
There is another N10 thread here where someone did this to have their phone unlocked BEFORE the 180 days........ file an FCC complaint online that they are being unfair with their unlock policy. In your case OP, it even makes more sense to do this. Once you file the complaint stating your problem, the FCC contacts Metro, and Metro contacts you. Then you tell them they are being unfair and you want that device unlocked. No guarantees but it is worth a try. Apparently FCC complaints are never ignored by carrier.
Device unlocking is based on IMEI.
If you got a new phone for any reason, it's a new IMEI which means a whole new deal.
Like poog said, take it to the fcc.
