The ban only applies to htc products that infringe upon select patents held by apple. htc will redesign their products by april of 2012 when this ban takes effect and will legally be able to sell them.
In short, nothing to worry about.

Yeah, probably not much to worry about, but the main patent in question involves functionality found in nearly every Android device. It sets an ugly precedent and makes a stronger case for Apple to possibly go after other top Android device makers.

2 things:
1.) apple will go after android mfgs regardless of if they win or lose these lawsuits. according to steve jobs android was pirated software.
2.) apple got samsungs products banned in germany and australia, but samaung has gotten the bans overturned by appeal OR has redesigned their products to evade the ban (galaxy tab). htc will probably appeal, and if appeal fails they will redesign their products.

There last 3 releases of the iphone have been underwhelming, and lacking in key features that most intelligent smartphone users come to expect. This being said they crush the competition in sales because of name recognition and marketing. The other day my friend was like why would you want android when you can get all of your information available in one spot like itunes? And Siri is awesome. I turned on my flyer and within three clicks we were watching Captain America for free in HD. He asked what app I was using, I said good luck finding it on Itunes

Apple doesn't need to die, they just need to come to the realization that their reign in the smartphone world is slowing coming down from their apex.
They're attacking everything that they patented and even patented things they didn't create. Hell, touch screen abilities existed way before the iphone ever came to fruition. They were just the first (I believe) to bring it to a phone. <- thanks for the correction redpoint73.
Whatever the result though, I see this as a big motivating push on HTC's side to do something new and more efficient/innovative in terms of the patent in question and have it slap apple in the face and be left behind yet again. All the while having no one to blame but themselves (apple).

Apple the first to use a touchscreen on a phone? Not even close. Windows Mobile, Palm/Treo, and others were doing it years before the iPhone ever came out. Apple just came up with gestures like pinch/pull to zoom and swiping that made smartphones easier to navigate for the masses (particularly without a stylus).
Big misconception that Apple invented smartphones, touch screens, internet in your pocket, etc.

Yup, HTC is probably just going to keep the feature, and implement it a different way. And all they have to do, is implement this change by April, and sidestep the ban altogether.
As ridiculously easy as it is to patent things that shouldn't be patented; its also easy to dodge the patents by just changing things a bit here and there.

Apple was never really AHEAD to begin with. Popularity != innovation. The business model they've been coasting by on is; take existing tech, make it pretty, market it as the creative option, and sell it to hipsters for twice what its worth. They've been selling the same damn phone for almost 5 years now, with very minor hardware & software upgrades with each 'new' model.
And only a moron would consider iTunes a plus. I had an ipod about 4 years ago & part of the reason I pawned it was because dealing with iTunes made me wanna throw it against a brick wall. I love impressing iPhoners with my phone too... their most common comeback is always "But... but... mine has a retina screen!" lulz

Considering Apple, Inc. was on the verge of folding just a few short years ago, I'm really surprised by the turn that Apple's made.

Every company forgets where they were and how far they've come. Take HTC as an example; they just about did it. They went from a company that embraced the developers and then, in a few short years, turned around and locked down their bootloaders.
Without social media outlets such as facebook, I highly doubt they would have reversed their decision to maintain locked bootloaders.
Apple needs the same kind of treatment to be reminded that the mass majority of users out there do not support their products (Android phones are outselling the iPhone, Android tablets have eaten into almost a third of the iPad market, and Macs still don't have nearly the same level of market penetration into the desktop/laptop sectors).

In a recent poll of 4000 consumers 35% said they wanted an iphone 5, even knowing nothing about it.

iPhone owners already can say nothing. Their cloud "innovation"... we've had that via Google for years. Siri... we've had that for a while too. Search the market for Jeannie (AKA Voice Actions). I put Voice Actions up against Siri the other day at lunch and Siri got literally every question borked. Voice Actions on Android did much better. We asked Siri "What are the nine planets". It said, "I found six planets... the closest is 2.2 miles from you." I hope not! We asked Voice Actions the same thing and it came up with a picture of the solar system plus a description of the planets. Other questions went similarly. The iPhone junkies at the table were REALLY impressed when I asked Voice Actions "Show me some boobies". Then I showed them the results and said, "Try THAT on your iPhone!"

God my company issues iPhones as a company phones (mostly to Execs and ITs) and they brag so much about their iPhone that I die a little inside each day. Something about that Apple brand that makes them believe they are top hip elitist. I don't hate Apple, I hate the people who worship it

Hrmm, I think part of it on anyone other than Apple's OS definitely has to do with Apple becoming what they advertised against. The breakout Apple commercial was that woman coming and throwing a sledgehammer at Big Brother - one way of doing things, one computer, one order.
They became that - they advertise artistic and non-conformist and people line up and say "I'm so different" as they purchase something they can't make a change to without jail breaking the OS.
Last I checked, if you want to develop for iOS you have to pay to play. I may be off on that as it has been a while since I checked.
Apple shooting lawsuits left and right for "stolen innovations" such as "slide to wake up" have not been engendering kindness.
The marketing and legal departments have been fueling the dislike, and posers who get phones for a status symbol.
There's a long and well documented lead in to the hate, and in the end it works extremely well to line various company's coffers.

And yet, they sell more and more phones everyday. I loathe the company itself. I like their products. Don't get me wrong, the iPhone/iPad/iPod Touch are GREAT devices, but they're not Android. And they're not even close, IMO. I have an iPad issued to me from work. The only thing I use it for is to read, watch movies (that I get outside of iTunes), and listen to music (Pandora/Shoutcast/Music I download outside of iTunes).

I think there's also some sort inherent disconnect between camps.
Apple people think they have the greatest device because it looks pretty.
Android people think they have the greatest device because the hardware is faster and you can make it look pretty.
Apple people think that if you have to work to make your device look and perform awesome that it's you who is making it awesome, not the product. (IE you win Android fail)
Android people think that if you can't make it look and perform like you want then you're a moron or the phone is crap.
It's sort of like a broken down 57 Chevy. An Apple lover looks and sees rust and decay, and Android user sees potential - HTC didn't make Sense awesome, but I can.
It all gets worse when you have people on both sides who don't want to learn anything and believe their respective marketing departments.
Any interest in this or shall we keep debating Apples to Orang-uh hum! Droids?
my dislike for the company is in the fact they spout innovation yet they are always a year behind the rest. hell look windows 7 phone has 4g now where is it for the almighty iphone? They spout innovation on their new ios and android has already had it on of their phones for a year. and the masses to dumb to realize they are paying extra money for a phone that is at least a year behind the curve. Well I see in a different way, sure iPhone 4s looks outdated because it doesn't have lte or WiMAX, in my experience lte is really nice too bad it has more lost signal then 3G and WiMAX is ok but man does it suck, I used 4G on my OG evo for a few months and stop using it , it just sucks I prefer 3G also in battery life 4G sucks at that right now, they need to come out with a new battery tech or wtv, I have an iPhone 4S, evo 3d, nexus s (tmobile) and my old 3GS and after playing with them I prefer both, i do prefer an iPad instead of android tablet but that might because of the apps, is nice to read books on my iPad or watch YouTube, and some apps for work , if android tablets would have a nice spreadsheets app and maybe some better apps ill probably go for it, but maybe another 6 months before that, the new asus table (quad core) looks nice but will see

Apple made the smartphone stylish. Treo made the smartphone useful. I was checking corporate email while apple was still ensuring cases expose their logo on the back.
If anyone started using siri other than apple, they will shut you down quicker than you can brag to your friends about it.

Unfortunately, I own an iPad (as is obvious from my signature). At the time it came out there were (in my opinion, so please don't post "WHAT ABOUT THE XXXX??!!") no comparable Android tablets. Also unfortunately I can't justify buying another tablet based on my dislike (now bordering on, sigh, hate) of Apple. I only use my iPad for browsing, Kindle app, streaming video and music (that I didn't buy from iTunes) from my HTPC, and Netflix. So the sum total of money Apple made off me is from the hardware. And that won't be happening again anytime soon.

I also unfortunately have the new iPad, but only because it was a gift for my college graduation/birthday. I mean I'm not going to turn down a great tablet, but I've bought maybe two apps and not planing on buying anymore, and one of them was a game I had already bought on Android. I only use it for web browsing really, I wish I could root it lol but I still hate Apple.

There was a comment on the article that someone made that they contacted Sprint about the delay on the Evo 4G LTE and they said that the delivery date will still be the 17th/18th. So it might have just been a particular shipment but it seems those who preordered will be getting it
I had no intention of buying the Evo LTE, but this really pisses me off.
Someone needs to address this broken patent system. And every single one if Apple's patents should be reviewed by someone who is not on Apple's payroll and is actually qualified for the task at hand.
This is beyond frustrating. It's time sure google to start defending their OS.

I heard that they're already shipping too. It's because they would have already had the initial rollout within the country. It's after that shipment that we will see shortages.

Most of the iPhone and Mac users I know bought Apple products to be different from the masses and avoid greedy corporate conglomerates (ala Microsoft). Ironic how Apple has become the very beast that they sought to avoid.
On a side note, Apple's vague software patents should be nullified. Software patents in general are sketchy at best. Patent reform is greatly needed....technology innovation and choice will suffer greatly if something isn't done.

I think we should file a suit against apple for patent and judicial system abuse. Their weak patents and ridiculous lawsuits are costing us dearly. Their ridiculous patents are delaying our phones. They are new to this game and don't have right to be such a holes. Anyone here an attorney and willing to put these rich pricks in their place?

Dude a slight delay in your brand spanking new phone isn't a cause of action. It's not like you don't already have one. Good luck demonstrating economic or even any loss at all.

Two parties does not equal class action, but you are right, they may have a claim. However, Apple appears to be acting in good faith (ie. protecting their patents) so it would be hard to prove that they did this purely out of malice or a motivation to interfere.

This is why corporate crime should be policed just as heavily as personal. There was clearly a crime committed here, and the U.S. Government was their weapon. How malice and messed up is that? News of this comes to a company on the day it's launch phones are in the mail? Apples pockets are deep, I guarantee they knew what they were doing. If it looks like s.... smells like s.... and tastes like s.... it probably is s....
And here sprint fronts the bill, when they shouldn't have to and buys everyone who waited a case.
Again - I don't think your seeing the legitimacy of Apple's claim. I'm not saying it was right, or that they are right. In the eyes of the law, they do have the right to make that claim and enforce it through legal action. Now the real issue comes down to whether or not Apple is hindering HTC's business purely to mess with them. I don't think that is the case - it would cost millions of dollars to enforce such a claim with absolutely no guarantee of success. Yes that is a drop in the bucket, but justifying that kind of legal expense has to occur on someone's budget.
It would be up to HTC's counter-claim (if successful) to prove more likely than not - whether Apple's action was purely obstructive. The law will always look at the evidence in the light most favorable to the person being sued (similar to the concept of jurisprudence), and in the case of a counter-claim that would be Apple.
HTC's claim of obstruction would have to be clearly egregious in order for it to be sustained in court (likewise, Apple's claim of infringement). For those of you who have a problem with this - pray that you never become a defendant in any court matter.
Guys, lets think clearly for a minute- please.
Apple believes that they have a patent that HTC has infringed upon. They take proper action and bring their claim in font of the International Trade Commission. The ITC then sides with them! How Apple can somehow be responsible for intentionally causing damage to a potential "class" for the above actions is beyond me.
Anyway, lets continue for the purpose of illustrating the absurdity of Apple being sued.
The ITC judge tells HTC that they need to remove the features from the phone that Apple holds patents for. HTC agrees. Then, subsequently HTC comes back and states that they don't feel they need to remove the core functionality, as they have found a way to code around the patent. Whether or not this had any impact on the delay itself, I don't know but it could have.
Even if somehow, the ultimate conspiracy theorist was able to prove Apple somehow had done all of this purposefully, Apples claims are still 100% valid.
I do believe that the guys in Cupertino got a huge rise out of this, I am sure they were laughing their asses off. However, from their perspective this is just a fortunate side effect of a completely legitimate claim that was being enforced by an International body and not Apple themselves.

Tried this on my Evo 3D (because the ICS ROM also ships with this) and unfortunately it doesn't work =( once I clear defaults and I try to tap on a YouTube link, nothing happens.
I suggest people try it on the Evo LTE, maybe it works there because I have Sense 3.6, perhaps and hopefully it works different on 4.0.
Haha, I share your pain, I too feel slighted by this recent fiasco. However, as stated already, there is no "class action" suit to be had. So what are we left to do, what can we the mere lowely consumers do? Don't buy Apple. Simple.
Maybe after you and I recieve our phones, we "show off" our phones to those we know that own an iPhone. Perhaps we do our best to promote the Android platform. Explain the inherent superiority of open source. Demonstrate the overwhelming edge we have in capabilities, & customization abilities.
The sad fact is, Apple has the lions share of the market, extremely deep pockets, and apparently the ear of some influential higher-ups. Not to mention the mindless fan boy, status symbol toting majority of iPhone users that will buy an iPhone regardless of what may come along, just because it's an iPhone.
But take heart my Android loving friends. How long has it been since Apple has had a revolutionary idea they brought to the table? When did their business strategy go from marketing to desperate/frivolous patent infringement claims? How far behind the curve are they?
Go take your shiny new phone and compare it to a new IP4S, what do you notice? Sad isn't it? It's a matter of time. Open source platform IS the future. Apples closed source, "we own that idea" mentality WILL be it's downfall. Might take five years, could be twenty, mark my words, Apple is headed for decline, and they know it.

All in all, I gotta say it's a beautiful phone. One aspect of Apple has always been great design. Two pieces of glass has in fact proven to be an ignorant decision, but damn if it doesn't look good. Still it does bother me to see so many people happy to see outdated features. I had canned sms and sms reply (call rejection) well before I ever owned a smartphone. The panorama? I have quite a few nokias lying around that have more then a reasonable amount of vacation panoramas. LTE? Poor Steve, he really believed it was too early and I'm easily swayed by his argument considering that all major providers are still in the middle of expanding lte coverage. So what if android got it first? How many of you can actually use it reliably and not as a "look what I can do" moment. NFC? Again, Steve Jobs believed it was too young of a technology and thus an unnecessary impact on performance (however small). Look around, how many reliably working nfc terminals are in retail? I have two gas stations that support nfc, but only one will accept my evo. The phone is nice, the quality definitely appears to be a step up from the previous, it finally has features that bring it up to par with the cellphones I had in the 90's. I still don't like Apple products, I don't think a certain incomplete (yes, even Andy Rubin has admitted it's far from what he considers finished) linux based operating system is any superior. I like my particular phone and it suits me for the time being. I will never understand why so many people take such pleasure in seeing ill-informed people who's more rational sense of being is being obscured by vanity.

Would you want to appear a foolish rube out of touch with technology? It appears to be vanity more then ignorance or stupidity.

I totally agree.
You may be right, they could be vane. They could just be techno-stupid. I would have to attribute it to Apple's superb marketing.

They do have a reasonably aggressive marketing strategy. The beauty of it, is that it does not appear aggressive at all (lawsuits are not marketing, although in Samsung's case it could be)

I agree but acting like you "know" when in fact you don't, makes you come off as more of a jacka$$...
All in all, the iPhone is a nice device, as to simply put it, "it just works". I recommend them to my non tech savvy friends that don't tinker with their phones and want a device that "just works". Different strokes for different folks... You will never see me carrying an apple device, EVER! :beer:
