Google doesn't own Android patents other than the Market and some other apps. Android is an open-source project. The notification system in Android is not patented...but it may well become patented...by Apple now.

Apple won't patented, last week they try to patented something new about multitouch and they didn't let them so I doubt it
from my shooter rocking myns ROM

That was the term "Multi-touch". Apple wanted to copyright it. The term was determined to be too widespread and common to become a copyrighted name. Apple does own the patent on mobile capacitive multi-touch display tech, though.
The war of the giants in which the only people suffering will be us the consumers. Why don't they all just share their technologies and let us choose.

Money.
If you can make your product the only one available on the market then you get the whole pie.
Think about it, if the only smartphone was the iphone, we'd all have one, most likely jailbroken etc to be useful, but Apple would have had their money from us for it.
Even if you can stop one company's product for a few weeks you weaken them and will increase your sales by reducing consumer choice.
The information technology patent wars are completely out of hand. This would be a terrible development, if Google brought Apple to court on something silly like the "curtain" UI feature.

I wouldn't be surprised if Apple DID patent it, ESPECIALLY now that the patent is issued to the "first to submit" rather than the "first to invent." To be fair, it's my impression that the "first to invent" standard was pretty hard to enforce.
But nonetheless with the patent process streamlined and less rigorous, the primary change will be that patent trolls and giant corporations will have an easier time making frivolous patents which hurt innovation rather than encourage it.
In conclusion... I'm voting for Colbert 2012.

Apples issue is that they have enough money to buy their patents. Most of them are so vague they have clearly just paid off the patent office to issue it. I mean seriously, i'm sure one of their patent was for using icons to launch applications, like they were the first to ever use that!
They just seem to pump money endlessly at anything. Did you know that iCloud is actually a business name, and apple have just decided that they want the name, forget about copyrights. The whole system was set up to protect the little companies, now the big companies are using it as a weapon. Why don't they just invent new technology rather than patenting other peoples technology then blocking sales of it.
Microsoft are just as bad, they get through tough times by exploiting patents and having a rather large income from android sales alone, it was recently estimated to be somewhere around $300,000,000 just in royalties for software they didn't invent.
What's next, Apple have patented the act of suing someone over patents?
I think we'd all be happier if they spend their legal fees in R&D rather than just attacking each other, it's clearly not customer or product focused anymore!
it's pretty sad that apple spent all these money and time to sue other people when they could've done a better job on their products...

iPhone owners already can say nothing. Their cloud "innovation"... we've had that via Google for years. Siri... we've had that for a while too. Search the market for Jeannie (AKA Voice Actions). I put Voice Actions up against Siri the other day at lunch and Siri got literally every question borked. Voice Actions on Android did much better. We asked Siri "What are the nine planets". It said, "I found six planets... the closest is 2.2 miles from you." I hope not! We asked Voice Actions the same thing and it came up with a picture of the solar system plus a description of the planets. Other questions went similarly. The iPhone junkies at the table were REALLY impressed when I asked Voice Actions "Show me some boobies". Then I showed them the results and said, "Try THAT on your iPhone!"

You must not talk to too many Apple fanboys. All day long, they talk about how their phone is superior to any other. I laugh when my co-workers literally say their iPhones are better than my EVO 3D.

God my company issues iPhones as a company phones (mostly to Execs and ITs) and they brag so much about their iPhone that I die a little inside each day. Something about that Apple brand that makes them believe they are top hip elitist. I don't hate Apple, I hate the people who worship it

Hrmm, I think part of it on anyone other than Apple's OS definitely has to do with Apple becoming what they advertised against. The breakout Apple commercial was that woman coming and throwing a sledgehammer at Big Brother - one way of doing things, one computer, one order.
They became that - they advertise artistic and non-conformist and people line up and say "I'm so different" as they purchase something they can't make a change to without jail breaking the OS.
Last I checked, if you want to develop for iOS you have to pay to play. I may be off on that as it has been a while since I checked.
Apple shooting lawsuits left and right for "stolen innovations" such as "slide to wake up" have not been engendering kindness.
The marketing and legal departments have been fueling the dislike, and posers who get phones for a status symbol.
There's a long and well documented lead in to the hate, and in the end it works extremely well to line various company's coffers.

And yet, they sell more and more phones everyday. I loathe the company itself. I like their products. Don't get me wrong, the iPhone/iPad/iPod Touch are GREAT devices, but they're not Android. And they're not even close, IMO. I have an iPad issued to me from work. The only thing I use it for is to read, watch movies (that I get outside of iTunes), and listen to music (Pandora/Shoutcast/Music I download outside of iTunes).

I think there's also some sort inherent disconnect between camps.
Apple people think they have the greatest device because it looks pretty.
Android people think they have the greatest device because the hardware is faster and you can make it look pretty.
Apple people think that if you have to work to make your device look and perform awesome that it's you who is making it awesome, not the product. (IE you win Android fail)
Android people think that if you can't make it look and perform like you want then you're a moron or the phone is crap.
It's sort of like a broken down 57 Chevy. An Apple lover looks and sees rust and decay, and Android user sees potential - HTC didn't make Sense awesome, but I can.
It all gets worse when you have people on both sides who don't want to learn anything and believe their respective marketing departments.
Any interest in this or shall we keep debating Apples to Orang-uh hum! Droids?
my dislike for the company is in the fact they spout innovation yet they are always a year behind the rest. hell look windows 7 phone has 4g now where is it for the almighty iphone? They spout innovation on their new ios and android has already had it on of their phones for a year. and the masses to dumb to realize they are paying extra money for a phone that is at least a year behind the curve. And yet the iphone fan boys think their phone is the best then i ask what makes it better then i pull out my evo 3d and im like had that since.... and had that since..... their ignorance drives me up the wall

Well I see in a different way, sure iPhone 4s looks outdated because it doesn't have lte or WiMAX, in my experience lte is really nice too bad it has more lost signal then 3G and WiMAX is ok but man does it suck, I used 4G on my OG evo for a few months and stop using it , it just sucks I prefer 3G also in battery life 4G sucks at that right now, they need to come out with a new battery tech or wtv, I have an iPhone 4S, evo 3d, nexus s (tmobile) and my old 3GS and after playing with them I prefer both, i do prefer an iPad instead of android tablet but that might because of the apps, is nice to read books on my iPad or watch YouTube, and some apps for work , if android tablets would have a nice spreadsheets app and maybe some better apps ill probably go for it, but maybe another 6 months before that, the new asus table (quad core) looks nice but will see
I love android far more than I love Apple, but I have to admit that apple was the innovation that started the smartphone race. Even though I believe Android is much better that Apple now, I believe there wouldn't be Android if it wasn't for Apple. Flame me if you want...

Apple made the smartphone stylish. Treo made the smartphone useful. I was checking corporate email while apple was still ensuring cases expose their logo on the back.
If anyone started using siri other than apple, they will shut you down quicker than you can brag to your friends about it.
The andiod os was oringinally going to be the google os back in like 2004 but when things didnt work out and google saw that the iphone take off they applied it to smart phones
I think we should file a suit against apple for patent and judicial system abuse. Their weak patents and ridiculous lawsuits are costing us dearly. Their ridiculous patents are delaying our phones. They are new to this game and don't have right to be such a holes. Anyone here an attorney and willing to put these rich pricks in their place?

Two parties does not equal class action, but you are right, they may have a claim. However, Apple appears to be acting in good faith (ie. protecting their patents) so it would be hard to prove that they did this purely out of malice or a motivation to interfere.

This is why corporate crime should be policed just as heavily as personal. There was clearly a crime committed here, and the U.S. Government was their weapon. How malice and messed up is that? News of this comes to a company on the day it's launch phones are in the mail? Apples pockets are deep, I guarantee they knew what they were doing. If it looks like s.... smells like s.... and tastes like s.... it probably is s....
And here sprint fronts the bill, when they shouldn't have to and buys everyone who waited a case.
Again - I don't think your seeing the legitimacy of Apple's claim. I'm not saying it was right, or that they are right. In the eyes of the law, they do have the right to make that claim and enforce it through legal action. Now the real issue comes down to whether or not Apple is hindering HTC's business purely to mess with them. I don't think that is the case - it would cost millions of dollars to enforce such a claim with absolutely no guarantee of success. Yes that is a drop in the bucket, but justifying that kind of legal expense has to occur on someone's budget.
It would be up to HTC's counter-claim (if successful) to prove more likely than not - whether Apple's action was purely obstructive. The law will always look at the evidence in the light most favorable to the person being sued (similar to the concept of jurisprudence), and in the case of a counter-claim that would be Apple.
HTC's claim of obstruction would have to be clearly egregious in order for it to be sustained in court (likewise, Apple's claim of infringement). For those of you who have a problem with this - pray that you never become a defendant in any court matter.
Guys, lets think clearly for a minute- please.
Apple believes that they have a patent that HTC has infringed upon. They take proper action and bring their claim in font of the International Trade Commission. The ITC then sides with them! How Apple can somehow be responsible for intentionally causing damage to a potential "class" for the above actions is beyond me.
Anyway, lets continue for the purpose of illustrating the absurdity of Apple being sued.
The ITC judge tells HTC that they need to remove the features from the phone that Apple holds patents for. HTC agrees. Then, subsequently HTC comes back and states that they don't feel they need to remove the core functionality, as they have found a way to code around the patent. Whether or not this had any impact on the delay itself, I don't know but it could have.
Even if somehow, the ultimate conspiracy theorist was able to prove Apple somehow had done all of this purposefully, Apples claims are still 100% valid.
I do believe that the guys in Cupertino got a huge rise out of this, I am sure they were laughing their asses off. However, from their perspective this is just a fortunate side effect of a completely legitimate claim that was being enforced by an International body and not Apple themselves.
All I know is because of this Apple lawsuit my youtube links open in a browser and not an app.

Tried this on my Evo 3D (because the ICS ROM also ships with this) and unfortunately it doesn't work =( once I clear defaults and I try to tap on a YouTube link, nothing happens.
I suggest people try it on the Evo LTE, maybe it works there because I have Sense 3.6, perhaps and hopefully it works different on 4.0.
Haha, I share your pain, I too feel slighted by this recent fiasco. However, as stated already, there is no "class action" suit to be had. So what are we left to do, what can we the mere lowely consumers do? Don't buy Apple. Simple.
Maybe after you and I recieve our phones, we "show off" our phones to those we know that own an iPhone. Perhaps we do our best to promote the Android platform. Explain the inherent superiority of open source. Demonstrate the overwhelming edge we have in capabilities, & customization abilities.
The sad fact is, Apple has the lions share of the market, extremely deep pockets, and apparently the ear of some influential higher-ups. Not to mention the mindless fan boy, status symbol toting majority of iPhone users that will buy an iPhone regardless of what may come along, just because it's an iPhone.
But take heart my Android loving friends. How long has it been since Apple has had a revolutionary idea they brought to the table? When did their business strategy go from marketing to desperate/frivolous patent infringement claims? How far behind the curve are they?
Go take your shiny new phone and compare it to a new IP4S, what do you notice? Sad isn't it? It's a matter of time. Open source platform IS the future. Apples closed source, "we own that idea" mentality WILL be it's downfall. Might take five years, could be twenty, mark my words, Apple is headed for decline, and they know it.

Seeing how samsung stock is plummeting and the overall affect this could have on the android operating system, I feel this is relevant. Mods close if you disagree.
My issue is this. Most of the tech mags im reading are not covering the glaring mistakes made by the jury. There seems to be a finality to the court decision in the news. "See we knew all along apple was being copied and this is what it will mean in the future". Personally I feel this will be overturned. I'm going to site a source from Gizmodo which also sites the Verge as one of their sources.
This is a good read. Please weigh in. Please be mature. And anyone with legal experience please lay your expertise on us.
The mistakes made by the jury are down right embarressing. And their desire to talk to the media is just making it worse for them.

Apple is only adding to its demise as a company and a staus symbol. Personally i feel that all this court time they're using is a waste of tax payers money and time. What happened to the law about monopolies in the US im pretty sure thats what apple is trying to become. Is there no such thing as being better because you are not because you own a patent. Imagine what it would be like if sports and car manufacturers were like this. What do we just turn our cheek since its an american company and they're going against foreigners. I say the legal system needs to say f u apple step up your game so u can compete instead of being a ***** and running to mommy because some asshole at school took your lunch money.

That's what I'm hoping for too. But Apple's vendetta is against android in general, so I'm sure they'll find something to sue over...and there's still the hardware to consider. If Apple truly owns "rectangles with rounded corners", it'll be interesting to see what kind of form factors we'll be looking at in the future.

I think android as a whole i.e. google, htc, sammy, moto, and the low low end companies need to unite and fight apple and there bs patents as a whole and not one by one because it will be ruled in favor of apple everytime because they got home turf advantage. No american is going to rule against an american owned american built american ran company in america. That would go against everything we as americans have been taught and what we believe in. And 90% of americans for whatever reason are blind to the fact that america dont produce a third of whats built and made in america. Hell my ford was assembled and built in canada my chevy was in mexico oh and the kicker is my stryker (the 8 wheeled armor vehicle the army uses) was manufactured built and thought up in canada the company is just based in america. So if our military is going to go outside the US for weapons and vehicles then we should be happy and willing to do the same for our cell phones and other electronics and at least not be biased when it comes down to it in a courtroom setting.

All this is very upsetting to me .I don't like where this is going..and if something doesn't change the cell phone world may be in for some drastic changes... and I want my HTC s4 pro adreno 320 2gb DDR 3 ram and 4.7 HD display aosp phone... and i don't want apple ruining it
Despite being a dot net developer I've stuck with android because it can do more. If Google somehow loses ill go windows phone for sure cause I already know how to make apps for it.

+1 its so obvious from apples actions that android is top dog and apples trying everything it can to level the playing field. They can feel the walls slowly closing in and the lights getting dimmer for their reign as a technological giant and all they can do is claw and scratch at the dirt walls of the hole they dug themselves into. I for one find it amusing that they have to resort to this level of pediness (sp?) And just all together humiliating tactics that theyre trying to use.

From reading the article it seems the jurors didn't have the knowledge or maybe the willingness to preside over this case. I'm going out on a limb here but wasn't Samsung supposed to be judged by a jury of it's peers. Obviously the jury couldn't consist of electronic companies but it should have been made of people that work in that field or people with specific educations. Juries in trials like this shouldn't be picked from the general masses.
Also is it possible for Samsung to get a fair trial in the U.S
Its not possible for any foreign company to get a fair trial in the US were way to biased for that. Plus were in a recession so we need american jobs to stay in america and go to americans. Honestly its all politics and whoever has the bigger wallet wins the case or at least can get a decision of what they want. The legal system in this country is so far in the ****ter that it would take a total revamp of it to get it to be 5% better than it is now. 2 cases i can think of off top of head that prove this: the oj trial (what a joke) and the jon bennet incident granted these cases are old as hell and some people reading are say wtf are you talking about it still proves my point. **** even if you take a look at big business cases martha stewart goes to jail for alleged insider trading where as the top people in charge of enron walk freely with their pockets stuffed to the max. And citizens wander whats wrong with the country and how did we end up in the economic state were in now. End rant.

That would just make android more like apple. The point of android is choice, if all of our phones ran the exact same software and ui where's the choice? You would have to root your phone just to get something different. Which isn't a big deal to me because all of my phones have been rooted, but others like to be able to choose a different ui just by picking different phones by different manufacturers.

700 question complaint and they take all of 22 hours to reach a verdict. Even patent experts would need more time to review. Apple's own lawyers weren't prepared for such a quick verdict

This is a discussion about the Gs3's future sales after the announcement of the most popular phone on the market, there have already been numerous 'comparison' threads closed, lets not turn this into one of those.
After today's underwhelming announcement of the iPhone5, the people sitting on the fence about whether to switch to the Galaxy S3 or Note2 (or something else) have to make a decision.
I've been reading comments on Android fan sites, Apple fan sites, and 'Neutral' tech sites, and the general feeling I got from all of them is that the iPhone5 just hasn't done enough to persuade a lot of people to stick with them.
Now, obviously, this thing will sell like hotcakes for the people that don't know any different to make an educated decision / that actually like the iPhone anyway / have bought too heavily into the apple ecosystem to switch now.
But those that are in the know, like everyone who watched the olympics... the S3 was plastered all over the place ... and the people that were keeping up with the patent trials (anyone who reads the news) will now know that there are better offerings out there and most likely opt for a Gs3.
So, do you think we will see a significant boost from the already 20m phones already sold?

Samsung has done a wonderful job with the SGS3 and I'm sure the sales will keep up for some time, but it's not easy to convert Apple fanboys to Samsung. I don't think the sales are going to rise much further. The iPhone caught up pretty good (at least in the eyes of casual users).

Even those that have been sitting on the fence the last couple of months to see what Apple has to offer?
Also, a personal insight, my mom and sister got a gs3 shortly after release, and genuinely with no persuading from me. They aren't tech heads, but they knew a class phone when they seen it.
The guys waiting for today to make their decision i think will go galaxy.

I wouldn't under estimate the loyalty a large percentage of smartphone users have towards Apple. Most of us probably had an iPhone at one time and moved to Andriod because we expanded our knowedge to include other smartphones and made an informed decision. There are a lot of people that don't realize there are options and will still buy the iPhone 5. Not sure if they will sell 20M after what I saw today but I have learned to never under estimate people with loyalties...

My boss wanted to buy the iphone 5. He is very loyalty to Apple. But he started liking my S3. He already have doubts about buying iphone or not.
My mission: convert him into an android guy and wake him up to the reality

Of course, they'll sell shed loads. But the huge advertising campaign with the Olympics, the recent trial and those already on the fence should have the gs3 planted in their heads! I think Samsung will steal a good few of them.
Htc might get a wee jeg too if they get in the news regarding the lte patents (if that even happens)

A guy named John Pirsig (sp?) wrote a book titled, 'Zen and the Art of Motorcycle Maintenance' a couple of decades back. In it he proposes there are 'Romantic' and 'Classical' people. He and a friend rode across the US (in the book & maybe in real life) on bikes. He had a Harley and the friend a BMW. (patience, it's coming... ) When they rode up the Rockies, the bikes started playing up and while he stopped and worked on his bike, and finally realised it was the reduction in atmospheric pressure needing just a tweak to fix, his mate went and paid a small fortune in a town garage to get his BMW fixed.
Pirsig talked for a bit about those who want an end-result experience and those who wanted to enjoy the journey. Some people forever focus on the end result and miss all the learning and fun along the way, 'big picture' people for whom the nuts and bolts are a horror to be avoided at all costs - literally in the case of his BMW mate.
At the time, as a Helpdesk person, I realised most Mac users are Romantics, people for whom computers are very much NOT fun and who use them solely to get a result and because they have to. Windows users were often some of the same sort, using Windows simply because their work said they had to, but far more of them would, if the subject was explained in terms they understood, become interested in the process and learn to fix their own printer/Word/Excel issues etc.
Apple have polarised the world again with their same-old, same-old tactics. The recent court case against Samsung proves Apple have not lost their litigious attitude towards protecting things they stole in the first place. (WIMP from Rank Xerox) And again we are shown the division between the Romantics and the Classicals - these forums are full of Classicals - look around and you will see lots of people who post about how wonderful this or that version of a ROM is, only to upgrade instantly a new version or even a different ROM comes along.
For most XDA'ers, I think the journey IS the end result - we tend to be travelling along with no particular goal in mind apart from a nebulous 'perfect phone' concept, and if all the developers stopped producing new ROMs to try we'd be heartbroken.
The Apple is good enough for most Apple users, be it Mac, iPad or iPhone. We will never convince them otherwise because they have sipped at the Kool-Aid fountain and like most religious people, they cannot even SEE the contrary information. It doesn't matter if the new iPhone has an A5, A6, A15 or quad or dual, it will be better in their eyes because it powers an Apple. They don't MIND buying expensive corsds ands connectors of all kinds because it is for Apple.
And they definitely don't see an ongoing development process as being a thing of benefit - Apple has spent far too many dollars convincing their world that you don't ever upgrade your device software, you just buy a new device. It is the proud boast of many Apple users that their product is far more stable than Windows, but my old enemy Microsoft constantly produced product that would work (most of the time) on any PC made across a spread of about 10 years, while Apple only ever made software for a very specific hardware platform - if you like, MS made an OS while Apple made glorified Firmware.
The same scenario is happening right now with Android. Android is being made to support all kinds of devices, with a legion of eager supporters providing updates and fixes. (on more of a Linux model than a MS one) Apple will not produce an iOS6 for their old phones, just for the brand new one you have to pay a small fortune for. Samsung (and other Android vendors) are producing updates so you get more life from your phone, providing a level of support to their clients Apple has never tried to match.
And eventually, the numbers will tell - just as in the PC/Mac wars, Apple had to compromise in both hardware and software, (Intel chips and running Windows on Macs) they will find eventually their tactics fail them. In my opinion, Android is the up-and-coming world of phones and pads, and Apple is the dinosaur relying desperately on massive programming... sorry, I mean advertising to keep their victims... I mean customers, loyal.
I think there will be a swing away from Apple as the actuality of the new phone falls far short of expectations and even the glitz Apple will give things will not hide the fact that all they have done is copy what is already being sold for hundreds less. But don't go expecting those weaned on the Kool-Aid to be coming over any time soon - the religious always resist the encroaching reality checks of the real world.
And on a personal note? I LIKE Apple for their litigiousness and mean spirit. If they had been sensible back in the late 80's/early 90's, we'd all be using Macs and locked down so tight I wouldn't have had a 25 year computer career helping others. For more than 2 decades I've had a job description of, 'I'm a bloke, and I fix stuff' that would never have been possible if Apple had treated their customers as anything other than sheeple to be fleeced to the maximum. Their greed allowed PC's to develop and become what we see, and now Apple's greed and contempt will allow Android the space to grow and become the new ubiquitous OS for mobile devices.

*grins* In 1987 I bought an XT clone (1MB Ram, twin 5.25" FDD's - envy of the few I knew with PC's because I could put my programs floppy AND my data one in at the same time ) to write books. I was sick of having to re-type a page or more just to change a sentence. 3 months later the PC got me a new job supporting WPO's at 3 grand per year more than I was getting. and I still haven't written my SciFi books. Working on it now and of course, along comes bloody Samsung S3 with Android and I'm fighting against techo distractions again... le sigh...
Forums like XDA will help greatly with selling Android; some older members need to recall that they once didn't know stuff but mostly folk are very helpful and there is a LOT of info to be had here. Mind you, it suffers a bit from popularity - search for something you want to know and you get like 5000 threads to look through. Needs an Advanced Search function, or maybe I just haven't found it yet. And why can't I search on the entire Samsung S3 forum? le sigh...
I think the reaction from a number of sites about how the court case showed Apple users how they could get everything Apple offered for far less if they stepped away from the Kool-Aid spigot shows an interesting facet to the competition. I haven't seen such comment before, even for Mac/Pentium battles. Usually it was about the differences, not the fact you could get the same thing. It could make a difference, particularly if the members here make a point of posting such a view on any/all forums they are members on.

It is surely a good day for people that knows stuff from the gadget world but for common people they are still awed no matter what. The power of Apple's marketing can even turn a pile of scrap metal into gold.
