Material Contract Change for sprint, do these qualify? - HTC EVO 3D

I saw on engadget about 2 changes sprint is making. one for for the tiered etf plan and another for changing numbers. do either of these constitute the contract change policy. I'm looking to cancel sprint, just can't take the slow service anymore. But dont want the etf's either. just wondering. thanks.

I would say with 95% certainty that the number changing fee does not qualify and the Total Protection thing doesn't qualify with 80% certainty. You could try it if you had the TEP before the change.
Other than that, it's like pulling teeth even if they up your rate or fees on your account. I had Verizon tell me to get a lawyer if I didn't like their answer. lol

Naa..no material changes here. Neither is part of your contract. Both are optional.

Unfortunately, I havent been able to find a job in almost 3 years and cant afford my bill. Is there anyone that can help me cancel my line and waive the ETF?

Right now Sprint is raising some of their regulatory charges, you can argue that these increases represent a material adverse charge which in accordance with their contract allows you to exit your contract with no ETF. I used this to exit Verizon, it should work with Sprint too.

Sprint defines the regulatory charge as "Sprint Surcharges are rates we choose to collect from you to help defray costs imposed on us. As this is not a fee required by law and explicitly a fee Sprint chooses to collect it is in fact covered under the material adverse effect clause.

The contract does not stipulate that Sprint may choose to mitigate a change in contract with an account credit. However the contract does explicitly state my option to cancel the line. If I were to accept or not accept the offer, which has no basis is the written contract, the material adverse effect is still represented in the new contractual fees.
In Cunningham vs. Fleetwood Homes of Georgia, reported at page 611 of the third Federal Reporter, volume 253, the Eleventh Circuit Court of Appeals ruled that arbitration clauses are material terms to a contract.
If the contract has in fact been altered to allow for mitigation of the charges by account credit, then my standing in a potential arbitration has been negated. So such a clause, having the potential to alter my standing in arbitration would itself be a materially adverse change.

I've seen it somewhere that you can sign up immediately after through a third party vendor, specifically wirefly was suggested. I can't remember where I read this though, may have been here on XDA

Wow! Just... Wow! I'm not even with Sprint (I'm up in Canada), but I must say, I'm impressed! I do love to pin large corporations to the wall and make them accountable when need be! I've used somewhat similar tactics to have early upgrades, waived fees, even got a free computer once from my landline provider (back in the stone age when I HAD a landine)
I've found you can get just about anything you ask for as long as you do your homework, keep a cool head, and when in doubt, ask to speak to a supervisor. Good on you man

Sprint is Nickel and Diming us

Sprint is making some more changes starting early next year. Apparently Family plans are going to lose the extra Employee Discounts, off the second line. We all know Sprint cancelled the discounts off the additional lines (line 3 and up) some time ago.
If you have an Employer Discount, the way it works now, is that you get a Discount (20% for me) on lines 1 & 2, as they billed together as Primary and Secondary. So I get $25.98 off my plan every month with the discount. Effective February the included line TWO, will be split as a separately billed line at $19.99. Line ONE (the Primary) will be $110 as it's own line.
So you will only be getting the Employer Discount off Primary line ONE, which now costs $110. Lines TWO through whatever, will get no discount. My bill will go up an extra $4 basically. Not the end of the world, but just another cut they have implemented. I remember I used to get my Employee discount off all my lines. Just makes you wonder what's next?

I can honestly see that change coming about, right before they officially roll out LTE. They may let it stay for a while under Grandfathered plans, but if you wanna upgrade...bam there goes unlimited.
Meh...its not like there aren't other options. I wonder if you could use this sudden change of contract as a way out of your contract? I mean after all, it's no longer the family plan you signed up for if they change it, right?
Yes you will be able to. Any change that you can claim adversely affects you financially and they legally can not enforce the ETF as a way out. This includes any change in Billing, whether it be 10 cents more in taxes, or partial Pennies. Any and all increases can be used to get out of your contract without ETF. I have heard of People given a hard time with this from multiple carriers, but in that case it is just talking to the right person.
For anyone given a hard time use this "You have an option here, either allow me to cancel my contract without penalty, or give me your full name, and employee identification number. Transfer me to a supervisor so I can get his/her name and ID. You will be named in my complaint to my state district attorney for breach of fiduciary duty and breach of contractual law. Afterwards if necessary I will retain a lawyer if necessary."
This tells them that they have broken two laws, and are aiding in the broken law if they don't escalate the matter to someone authorized to make decisions on contract releases. If they broke the law and it isn't taken care of you will be sending the matter to your state attorney general who will initiate a class action lawsuit, where the person will be named. State attorney generals really will act on this. On matters that affect many many of their constituents that can reelect them, they love taking and fighting the case. I'd almost guarantee after this threat that they will let you out ETF free. I have used this a dozen times successfully on contracts with carriers and gyms, etc when they broke the law. Works every time. Not a matter of if, just a matter of time
I'm about done with sprint personally. As far as post paid carriers go they are the cheapest. But compare the quality of my service compared to all the prepaid people at work, I'm paying twice what they are paying for the same quality/data speed.. All I have to show for it is a better phone. BTW i played with a galaxy nexus at the mall today, I ran a speed test 16mbs'sec download and 4mbs'sec unload!!!!!

Ya sprint is really starting to suck. All the stuff they have done this year doesn't justify their crappy network signals. Maybe I should look at closing out and re signing up in my wifes name to get a few free evos.

I am trying so hard to hold out until at least the end of 2012 to see if things will improve with sprint as far as better 3g performance and a decent lte foot print but I am really starting to have some serious doubts. It really looks like I may end up having to switch to at&t pretty soon.

Same here. I'll move my family to Verizon or T-MO while I move to prepaid AT&T goodness. That unlocked international Galaxy SII is starting to look better and better...
Afterall, it's literally the best phone out minus the Galaxy Nexus.
In metro detroit the data speeds are so bad that I can't even stream pandora without a 30 second re-buffering between songs. One day i tried to download roam control to force roaming on verizon and it was too slow to even start the download.
Speedtest.net app shows my speed at about 0.05 mbit the vast majority of the time with .3 mbit the max i've really seen and that is at 6:30am when the network is clear. And all this with an extra 10 dollar charge for the privelage.
Unlimted data is a catch 22 for me .. with sprint and using my phone constantly I can never even hit 2gb in a month because its so slow. With verizon i would hit 2gb in a couple days. This employee discount deal may be my excuse to get off of sprint and onto a real provider.
Between my contract and being on my parents contract before that I have probably been with sprint for about 15 years.. the funny thing is I cant ever remember being happy with their service.

Because pre paid carriers get unlimited talk text data for about 50 a month. Since sprint is so terrible specially in the data department...its almost worth doing. You can get a pre paid carrier that runs on the Verizon network, so it's a definite option to consider.

As a "perk", I receive a 25% discount on our sprint family plan, since my company uses a lot of Sprint phones as company phones. Looks like starting in feb, they are going to change the family plan discount to only the primary line on the plan, not all phones. While this will only change my out of pocket costs by about $5/month, I'm curious if this can be used to get out of my contract early (I have about a year left). Lately sprint QoS has been lacking (dropped calls, unable to make/receive calls, no data, no texting, etc), and I've called Sprint a few times regarding this. I'd like to make a switch to another carrier, but I'm not sure if sprint changing a discount would give me a way out, like if an additional charge was placed on the bill, due to a tax, or some other fee.

Funny. I was able to get my contact on a month to month due to their last TOS change. I should cancel completely, re-sign with new phones, then cancel again in February due to the new change. Then just sell all the phones on Ebay (or here)
Then go to t-mobile. I haven't made it to 2 gigs of data in a single month with sprint at all this year. Actually, I don't think I have at all given their crap speeds.
For real though, when I first signed up with sprint all I could do was talk up their value. All the changes this year have changed my opinion when people ask. I now tell people just to go prepaid or T-Mobile. I haven't left sprint just yet, but I'm inching towards that door.

However, here is the key phrase to keep in your arsenal: “If a change we make to the Agreement is material and has a material adverse effect.“
This change is obviously material and the adverse effect is as it relates to you. They cannot tell you that this is not adversely effecting you as you are paying the bill, not them. They further provide you with the terminology to use when contact Customer Care: “specifically advise us that you wish to cancel Services because of a material change to the Agreement that we have made.“

As I understand it, with Sprint when you manage to find a way out of ETF they don't make you cancel your service, they just null your contract and leave you on a month to month. So you can take advantage of one these opportunities, and sit on it until/if they piss you off enough to leave them.
if they do really let you get off contract and still stay month to month that would be awesome as I want to do just that. anyone do this before?
I'd like some more info on this. Not liking Sprint at all atm.

Moved out of Sprint's Coverage...

Will it be possible to get out of the contract without paying the ETF? I have two phones on my account, mine and my mother's. I want to keep service. However, she's moved out of state and is roaming 100% of the time since there's no Sprint service where she now lives. What should I say to Sprint to try to not pay the ETF? I think the contract is up in November. Money is tight so paying the ETF isn't an option. I guess if nothing else, I'll just continue to let her roam and they'll eventually cancel the contract for both phones. But like I said, I don't want to leave Sprint. Any insight?
Just call customer service and explain to them that you don't have service in that area where you are using the phone and probably they will give u a chance to desconect the phone I did that with ATT and I didn't pay any dollar

We used to give customers airraves, the signal box that ties into your internet to provide cell coverage.
Since you say you want to stay with sprint, know they handed over a few to customers @ no cost.
Worth a shot.
Otherwise, if you pay for insurance, I know they modified that recently which would allow to get out since they are increasing cost of monthly insurance and replacements.

An Airrave would work if she were home 24/7. But if she's out that means 1x data still. I'll check on the insurance terms for getting out of the contract since I pay insurance on both lines. Hopefully that will work. But still, moving out a service area should be in the contract to allow you to break it as long as you can prove you moved there. Like a bill or something in your name.

Anyone heard or have any input for this website? Cellbreaker.com. It claims to break your cellphone contract without paying ETF's. I've seen it on the news, but still not too sure since per line its 77 bucks. Anyone use this and have experience to share?

I never heard of it until now, so I went to the site. First they want to charge you $10 to do an analysis. Then, IF they find breach of contract, you pay another $77 to them to get you out of it. So, that's $87.00.
Most carrier ETF's are $250, pro-rated for 24 months. This means that every month you have the phone, you deduct $10.42 from that $250.00. Once you've had your phone for 16 months, the price cellbreaker wants to charge you is MORE than your ETF would be.
Further, from what I'm reading on their website, the breaches they look for are price increases, terms changes, and "performance deficiency." Performance deficiency is very subjective. If you only have service 4 days out of 7, and can document it, sure, there's a breach of contract. But I don't think I've been anywhere where I have not had service for more than a couple of minutes. I've been with Verizon for 14 years and they have never once raised the price, altered my terms or done anything even remotely close to breaching their end of the bargain during any two year period.
In other words: try it if you want, but I honestly don't think it will do you any good. Even though it's "GUARANTEED" to get you out of your contract. Here's that "guarantee," by the way: Terms of Use TBD...

Yep. That sounds about right. Plus you would be responsible for your final bill, so it's important that you cancel prior to the end of your billing cycle.
Well, I called Verizon, and they told me that it would be 250 per line for the etf, bringing me 250+250+230=730 dollars for etf. Ouch

OUCH! That's strange to me. I was going to dump them a year or so ago because I could have received a better price through my job. But they're on ATT and I don't like ATT. Well, at least I like them less than Verizon. But big red told me the fees were prorated. I wonder if that has changed...

They got rid of prorated fees about two years ago. Now it's straight up 250 per line through out the contract.

Once you've completed your contract term, you'll automatically become a customer on a month–to–month basis for that line of Service. If you cancel a line of Service, or if we cancel it for good cause, during its contract term, you'll have to pay an early termination fee. If your contract term results from your purchase of an advanced device, your early termination fee will be $350 minus $10 for each full month of your contract term that you complete. Otherwise, your early termination fee will be $175 minus $5 for each full month of your contract term that you complete. Cancellations will become effective on the last day of that month's billing cycle, and you are responsible for all charges incurred until then. Also, if you bought your wireless device from an authorized agent or third–party vendor, you should check whether they charge a separate termination fee.

Based on what their site states they will analyze your contract for Carrier's breach and if they find one for $77 they send the communication to the carrier on your behalf to cancel your contract due to breach.
It seems highly probable being that your average customer would not be able to look at all possible breaches, as far as reputation well they claim they give you a 100% guarantee so that should cover you.
Did you pay the $10 for the analysis and did the analysis return a positive breach finding?
Well, I used a promo code that got me the analysis for free, and it did return with a breakable contract. I might just try it with one of my lines first, then see it it actually is true,then I will do the extra two lines.

To all --the term Caveat Emptor comes to mind.... Though this could be a benefit to some...... with the term contracts going away with each passing day..maybe yes...maybe no..... do your research before letting go of your money and or your privacy (which appears that this is necessary for this company to do what they do)...

I would choose cellbreaker again and again!

Out of curiosity what are you going to do when you leave your contract? If you go to T-Mobile they pay your ETF, if you go to Sprint they buy out your contract and cut your bill in half. So unless you are going to AT&T (why?) you could save yourself the $$.
