I do not like apple any more than the rest of us but . . . When somebody wins you have to give them their due.
Really, I expect that the judge did the best that could be done given the evidence. Samsung maybe pushed the limit a little to closely and didn't pull it off. Samsung has the edge anyway - except maybe not the size niche it would like. I think they'll get a lot closer after yesterday . . .

That patent pretty much describes LCD TV's, GPS devices, computer monitors.....ect. So stupid. This is why I hate on Apple. Not because I dislike their devices, because of their business practices.
If you think about the size of the companies involved there has to be enough creative talent to come up with an idea that is so different than what apple has it can't possibly be called a copyright infringement. The sooner these companies wise up and do that the better off we all will be.
The Patent Office needs to take some blame here too. Don't get me wrong, I do not approve of Apple's business practices, however, they're just doing whatever they can get away with. They shouldn't be able to get away with it, and that is why the blame should clearly fall on the Patent Office. The PO obviously has a lack of understanding pertaining to the technological field, so how are they the ones determining which patents to grant? They need to step up to the plate and throw away all of the frivolous patents that they ignorantly granted Apple. Again, that's the real problem here, if Apple doesn't have these absurd patents, they don't have all this power that they shouldn't have.

I actually really like Apple's products. I don't like the mice though, as they are awfully limiting in the UI. I don't like the complete closed house approach they use, but they are big enough to make it work well. I very much dislike their tactics though.
I can tell you that the vast majority of people out there just don't care about who is *****ing (sueing) at who etc. They just think Apple is the bee's knee's and that's all there is to it.

I just checked wiki for a comparision between the company I work for and Apple. My company's revenue and overall worth is much greater then Apple's. With that in mind....we had a prototype parts inventory audit last year and the initial numbers came back saying we were missing 1.2 million dollars (US) worth of parts. That became a huge deal. The parts crib went on a 2 week lockdown. R&D stopped. Big wigs from Germany came. 2.6 million dollars is a huge deal to them, trust me.

EDIT: Now that I am home and can type easier I just have to say that out of the context that we are all very well aware of I whole heartedly do not condone such obvious abuses of the patent system and the courts nor do I appreciate the stifling effect this most obviously does have on innovation. If you aren't a huge multi-billion dollar player with a huge patent pool and Google ain't got yo back, well, you are not entering the market. The barrier to entry is fncking astronomical. There will be no more paradigm shifting inventions from little guys...unless the little guy sells his innovation to someone with the money and the muscle and the connections to go to war with the likes of AAPL and MSFT. Monopoly, oligopoly, whatever form it takes...so long as bull**** like this persists there will only be tiny incremental moves forward in technology.
That said, I'm glad HTC is doing this. It is the only way to do big-tech business apparently. I agree the patent wars are quite insane, but mainly because it's mostly apple going after every android manufacturer because they sell a touchscreen device. Google has made it known that patent reform needs to happen now. I think all of the moto patent's are going to go towards crashing the system.

At work last week someone asked me that question and I just thought it was funny. I work in a technology company with Apple being the dominant brand of choice (of course). After explaining to him it was the new Asus Transformer Prime with the Tegra 3, etc etc he ended with saying; "oh, so it's like a baby iPad?"

I've been a mac (computers) guy since about 2001 and can't stand what they've done with iTunes iPod iPhone crap. I personally believe ios is for kids, women and grandparents. If you're any kind of a true "tech" guy you wouldn't be caught dead with an iPhone.

Unfortunately for some of us, it's dictated by the company we work for. Where I am, they pay for the device and service, so I get what they give me. I would kill for a Nexus or SII, but they just won't go that direction.

I hate it when people do that, and 99% of the time it seems to be Apple users...
So what if the iPhone/iPad can do that.. How does that help me? I have an Android device.
It's not just the iPad users that say things like that... My Grandparents (who don't own any apple devices) call any kind of tablet an iPad. They call my TFP an iPad, and hell, they even call my Dell Streak an iPad/iPhone.

LoL . Always happens to me,with "not so tech savy" friends,when they see my hd2, they always ask of it is the new iphone model....And when I answer that it isn't,they look so disapointed...and then ask if it is a cheap chinese copy of the iphone....

I used to have this on top for all passer-bys to see, but after Jobs died I was forced to display it in my cube only.
And yes, that is a VHS tape with a coffin-ized Apple logo. It was a gift and I found it quite appropriate.

lol. If I'm not mistaken iphone is also made in china. I have so many friends with iphones and they praise it like its the best thing ever. When i tell them to go to this website (with flash) or I show them google nav turn by turn on my Evo 3d, then they're like "oh man mine doesnt do that" lol.
My other friend used to be an android fan but after getting an ipad2 he thinks apple is the ish and is bragging about ipad3 already even when it hasn't even come out yet lol. Unfortunately hes moved over to the dark side forever....
I am in college, so maybe I am in an environment of slightly, and I emphasize 'slightly' more tech savy people in general. Not many people here own iPads, but many of the people who see my TFP are overall impressed.

I do occasionally get "oh did you get an ipad" but then I quickly correct them.
I actually sat down at a table with someone who had an iPad 2 and another person with an iPad og. Being that they were stuck in their iLife, they were seemingly unaware of the existence of android tablets. They were generally impressed with the look and feel of my transformer.. and there was one person at the table who had used to own an android phone then switched to iPhone (not entirely by choice) so they knew the shortcomings of an iOS and were very impressed by what I could do with my tablet and they could not do with their ipads.

Apple is coming off as a spoiled brat to me and it is getting really annoying. They get to sue Samsung for its alleged rip-off of features but when apple rips off android's notification system no one should sue them!!! Jackasses. :/

The patent system is broke. That's the REAL culprit here because it enables companies to make these ridiculous lawsuits.
I don't think Google would sue over the notifications because they understand that in this industry everybody is going to use a good idea when they see it. Success isn't just good ideas, it's who makes the best product with the idea. I wish Apple would just suck it up and get back to work like everyone else.
This is also really hypocritical of them. A long time ago, Steve Jobs attributed their success to the fact that they're not afraid to steal good ideas.
Also, the fact that they're targeting the Nexus's lockscreen, which is less like Apple's than most phones out there, proves that this is purely competitive, and less about protecting IP.
Those who can, do. Those who can't, sue.
Eh, it goes both ways. There's hardly a company in the mobile industry that doesn't have ongoing lawsuits against them and and started by them. It's just the way these things have been allowed to happen. Yep, ip law is very broken.

These corporations are really not all that worried about these law suits add you might think. For the most part, they continue on with business as usual... (from engineering and business standpoint)
Legally, these law suits are a political game. Apple has an unbelievable amount of money. They are trying to run the legal costs of these companies to run them out of business.
Apple sees a competitor who is actually doing better than them and they try and ban the phone. God, I hate Apple. So what are they suing over?

I think every company with mobile patents should band together and share patents, just briefly, to sue Apple. End this once and for all. Samsung, HTC, Microsoft, Motorola, RIM, Palm, LG, and anyone else. Burn them to the ground.

Apple is getting desperate. Their little fisher price phone is old and turning into a joke next to Android.
Most of Apples stock price is due to cell phone sales, so they should be scared.
I predict Apple will be bankrupt again in 5 years.

Eh, I disagree.
Compared to Google, Apple has their stuff together.
Google's aggravating flaw: They 15 versions of Android OS between how many devices. Android OS distribution has to be fixed.
I'm not saying that Apple products are inherently better- I enjoy having an open, customizable phone that is more than a screen of icons, and having superuser permissions.

They didn't. They brought it up last year. The judge said that HTC had until mid or late april (I forgot the exact date) of this year to fix the issue. ITC just hasn't gotten around to checking HTC's claim that they fixed it yet. This shipment is the first import since that date passed.

Underhanded, anti-competitive business tactics. This is the way Apple has always operated. Why is anyone surprised by this?
This is what they know is bound to happen (mind you, not with everyone):
1) Consumer sees delay in release of pre-ordered smartphone.
2) Consumer feels slighted and blames HTC/Sprint/Seller
3) Consumer says "Screw them/it... I'm getting an iPhone."
4) Apple profits...
Sad but true. This is business as usual in the Patent Age.

Doubtful... They still have other products outside of the mobile sector and a LARGE cache of patents to keep this going until something is done to prevent it.

It is just fun to joke around and pretend we can make a difference by complaining about Apple. Though I really will never own another Apple made anything(I hope they don't come out with the first flying car)

Why does it have to be fixed? If iOS doesn't exist is there a problem with fragmentation? Should I automatically get upgraded to Windows 8 because I bought a computer with Windows 7?
Truly I don't see it as a huge issue. The open nature of Android is what makes it great. The only way to mimic Apple's distribution model is by BECOMING Apple. Of course if you have 4 phones and 3 tablets with the software completely locked down it is easy. You said it your self there are how many phones running android on all sorts of different hardware and UI changes? It would be impossible to have them all running the same version of Android in the same time frame as Apple but who cares? If that truly matters to you buy an Iphone. I have had a blast with Gingerbread on my 3D and playing around with different ICS roms(please do that with an Iphone)
You call it a problem I call it options. Some are low grade running older versions you and I wouldn't touch, but it allows those of a different income to afford a Smart phone. Some people like a physical keyboard, some like big screens, some like smaller screens. Some people like Sense or TW and others plain old Vanilla AOSP. You are telling me all those options are worse than Google locking down Android and releasing 1 to 2 phones/year all made by Motorola(considering they own it) just so you can get the latest version quickly , because that is the only way? WHY?

Ya, this is some BULLSH**!! Crazy what the government is so interested about... Pathetic...
It's nothing to do with our bootloader unlocks and gaining root access. That piece pertains to the carrier unlocking, which is fine because if company A subsidizes the phone for you, then they don't want you to take said phone to carrier B, and have carrier A no way of trying to gain back that subsidy in service. If you owned a food truck, and handed out a coupon for $5 off, but the individual found a way to use that $5 off on another truck, you'd be pissed. Small analogy.
That still sucks and lessens competition. I own the phone regardless of whether it was subsidized or not. The monetary penalty for breaking the contract compensates the carrier for their subsidy. We don't need this restriction.
Telecom companies in the US are a classic example of government failure. We have a bad competitive environment on the wireless space, and a horrible one in cable and Internet. There we basically have unregulated monopolies that do an excellent job reaping us off.
The US got a lot of things right, but the telecom sector is certainly the weak spot.

This is nothing to really worry about if you buy an unlocked phone your good this only affects phones that come with a contract and even those you can go online and get the code ffor around 10 bucks
This is just NOT good period. No matter if it's bootloaders or root or just unlocks because these greedy ass carriers get stuck with debt from a customer that does not pay his cancellation fees... Ya right! These companies are charging us out are asses for these devices in the first place and then get heavily compensated by the rest, on charging you more than your house payment every month! This is just one more thing that is being taken away from us...It's hard enough trying to get some of these companies trying to unlock your phones even if you paid your contract fees now it's gonna get next to impossible to get YOUR phone unlocked after your service is done. No it does not affect any of us right now but things like this start and then they think they can do whatever they want next year... The percentage of people that pay their bills are FAR greater than the people who try to scam so this is just another law to protect the rich corporate companies in the US so they can have more rights to take more of your money. Okay, maybe I went overboard.... It's still crap no matter how you look at it.

Without truly understanding this situation I believe that uppon is probably right.
After seeing what devs can do (and it doesn't take a whole lot to amaze me) I'd say that the playing field will always be brought back to level by talented people on a mission.

do yourselves a favor and don't buy from carriers unless you can make sure that it is unlocked from day 1. of course, most of you probably already do that, don't you?! I will also be reminding my non-xda friends to not buy from the carriers also. Unfortunately, most of those people are too interested in the "cheap" $50 phone upgrade. Those people are the problem here.

I wonder how this will restrict people importing phones internationally and running on different region carriers. Would encourage even more grey importing!
Either way, this has always been a problem to some extent, but never permanent!

Completely off topic but I feel like discussing this. I just had a heated discussion with my niece who is 16 and always uses my spare SGS 2 over her iPhone when she is at home, because she likes it better. At school she told me she uses her iPhone because all of her friends have iPhone's because "it's what everybody has" were her words.
Apple only create 1 phone. I am SERIOUSLY amazed by the chickens that continue to follow the outstretched hand of apple, like a farmer with feed for his poultry. You can lead them around all day and they never seem to worry about variety, change or diversity. It's actually either a really dumb move or a really intelligent move to cater to everyone's needs with 1 phone. Luckily for them, Apple started a trend early on which snowballed due to mass marketing, the fantastic app store (only 1 phone for developers to tackle with very little drastic updates) and peer pressure based purchases for the likes of young and old!
I am a seasoned manager in this industry in a company called leetgeek and I can tell you right now that there is a very technically uneducated population, at least in my country as to what their devices can actually do. I just wish people had a clear understanding of the options available by researching and learning for themselves before making a purchase rather than following suit from their friends and family. Even when I ask them if they would consider another option, they already have their mind set. I honestly look at an iPhone only for it's simplicity, games and overall solid exterior. This is all some people want, and maybe they don't want to go any further than this and I can certainly accept that. My gripe is not with this type of person, it is with the people that don't know they could do a wider range of suitable tasks and potentially more with a different device but are too stubborn to hear it.
Is Android better than iOS? Well that is 100% a user based decision but for me personally, but obviously not for a lot of other people as they haven't bothered to learn. I can't for the life of me handle a little screen with home screen app drawers sitting their drinking a hot chocolate, telling my business friends oh look at this. I can synch my devices together so I will buy an iPad as well. Oh this is so amazing it's such a cool device!
