[Q] Warez...... - XPERIA X10 Q&A, Help & Troubleshooting

Hi
I notice one of the developers have had a download link removed due to warez.
I was also warned from other users in regards to an application SPB Mobile Shell beta was warez also and must not be posted.
Can I ask then what is the stance on Sony Ericsson apps,software?
When we purchase our phones we agree to not distribute,tamper with etc etc the software on our phones.
Surely then the majority of the developer threads on this site are in breach of this?

It is warez because the beta was a closed invitational only event so I have been told....

I think warez relates more to paid products

I thought so too :S The beta thing still confuses me.. It isn't the full release, it was just a test release with many functions removed.

I read somewhere that a free beta app (aviable for everyone) can be shared without problems (even when the full version is out) but sharing a beta witch is/was NOT aviable for all will/would be a warez app

No offense dude, i'm not taking the side of the evil pirate.
But i got my experia from my uncle, so that point is invalid.
I think we shouldn't be criticising the OP, simply because installing AppPlanet does not constitutes piracy... you can't say for sure that he is going to install paid apps...
Maybe he has problems with Google market, and is only downloading free apps... I know this sounds improbable but we can't know for sure what his intentions are...
I for one, download from AppPlanet for testing purposes before buying the app... and nothing on this world (even a ban on XDA, like someone proposed a few posts back) will make me change my mind... simply because the 15 minutes refund policy on the market is ridiculous... if your phone freezes and you have to reboot it, you're doomed...

I, for one, never criticized the op...
Simply stated that giving him the link for appplanet would probably constitute warez and I'm not putting my neck on the line for op That is all lol
regardless of the reasons you use applanet (testing apps or whatever), applanet is still warez and against xda's rules.

Nope, You Have A Choice Of What You Want. It Sounds Like You Need To Be Bone Stock With The Bootstrap.
I'm pretty sure the pre-rooted version is the full update with preloaded root access so I'd say just the root will cover you.

i had the same question like 15 minutes ago when i saw his twitter post about TBH. It is apparantly and app made by a group of phone hackers to distribute leaked files, they charge for the app because, according to a forum post by P3, it does cost money to get sbf files leaked. Im not 100% certain all the features of the app because i dont own it, if you google 'p3droid tbh' you can probably learn more about it.

I am curious to know what is so different about his update script that allows it to install root. From my understanding you have to have the su app in /system/bin, perhaps it's just an added line of script that installs it during the update. Either way I wish he would go ahead and release the links instead of dangling this in front of everyone.

Ics leaked roms - legal?

In lieu of all of these leaked ics roms from someone inside Samsung is this considered theft? And if we have this on our devices isn't there a chance we could potentially get in trouble if the right person were to find out?
With that said, xda does not support piracy because the software costs money and is given for free. The same goes with leaked roms that were stolen from samsung right? So xda mods, how can you support something like this and allow it on the forum? I'm neutral to this argument and would like your thoughts.

The "leaked ROMs" are technically made up of open source material, so there is no theft issue. As for the person leaking them, they may be subject to disciplinary action by their employer, but there is no illegality for having said ROM on your phone. Most of these supposed "leaked ROMs" are actually leaked on purpose by the manufacturer as a way to get the flashing community to do their R&D for free. We are only too willing to help them in that.

Its not theft per say. These are roms (or software if you will) that is build from free source code provided by Google and is made FOR OUR PHONES. They have to build several roms to make sure all the bugs are out. They send out these "leaked" roms to testing to find all the hidden (or non-obvious) bugs so they can fix them before the rom is considered gold (or stable, official). You know as well as I do that once something hits the internet it spreads like wildfire, so thats how they get out in the masses.
Since there is no price on the roms and they are built from free source code, XDA is not responsible for anything in this regard.
The Apache license is a grey area in this regard. Similarly, the ICS leaks technically ARE GPL violations in that kernel source hasn't been included - however again it's a grey area since technically we're not supposed to have the binaries in the first place.
Also, I believe most leaks are not obtained by "theft", but by using an undocumented firmware update mode that lets the leaks be downloaded directly from Samsung's Kies update servers.

Hmm it just seems like that argument wouldn't hold up in a court of law? Its being taken no matter how you slice it. It was built using source but where's the intent to distribute? If there's no intent (yet) then they aren't obligated to release it based on gpl.

As Entropy said, its a grey area. I guess technically it is a violation of GPL due to source not being released with the leak, but then the leak isnt being documented as gold or official, so since its still in its "testing" phase, it dosent count (which is why all leaked roms are required to say that they are leaked testing roms, not official and to flash at your own risk... official dropped roms will say official). Now if somebody took a leaked build with no source and distributed it as gold or official, then yes that would not hold up and would be in direct violation and could be held accountable.

Declaring that something is a test version does not permit you to withhold source code.
The main thing is that if you read the license, if you give the binary to someone, you are supposed to provide source. If you received a binary from someone with a written offer for source, you must pass on that written offer.

I should have been more clear. I didnt mean that it permitted anyone to have without source code... but merely that Samsung does not have to provide it yet since it isnt official. By Samsung giving out a test build to test for bugs, they do not have to give out source code yet (mainly why they kept testing in house so its blanketed under the same company because the company does in fact have the source code from Google) until they release it outside the company.
And yes, just because some members intercept the leaked test builds, they were not handed to by Samsung which is why they do not have the source code in the first place. People here distribute it to other members but it is not attached here on XDA, they upload it to a share site and simply post the links here at XDA.

Yup - that's basically it. The people whom Samsung is actually "providing" these builds to most likely have source code access.
We don't have source because they didn't really "provide" us the leak.

OK guys this has gone on long enough. To respond to the OP. OEM have long allowed early builds to be leaked to XDA for bugging hunting and troubleshooting. Should do a little research before you start a thread like this.

Don't care about windows. Plus we are talking about 300$ for an os vs a few bucks for a app.
Also, Jail breaking the iPhone was deemed legal by the us federal government.

The Google licensing system is the thing that's easy to crack. Google should fix it, not the developers. Titanium backup itself has "Guru" out something I believe, which checks the license.
But it's a long time since I read this thing somewhere, so I don't know if they still gold.

Software is man made. There will always be a crack, or a hole. Nothing is 100%. This is why its illegal to do what you are doing.

- no data... it attempts to run but unsuccessful
- unable to change sounds (ie ringtone, notification) ... likely need a folder created on sdcard and store miui tones inside to work ... temp fix: use edge app to set different ringtone etc
- user agent for browser thinks its a desktop but doesn't load mobile layout for device ... temp fix: menu > advanced > user agent > change android to iphone
- themes app fc but works by accessing through the menu

ROM originates from china, try using market enabler to redefine the market area should fix that.. I also renamed the default folders.
Edit: oooh, you're running market app, check the folders from the first page and run play store instead lol

A mod can remove this thread if there's a concern otherwise I'll remove once the dev makes a post. Nevertheless, the dev made it public posting it on dev-host for all.
p.s. - I agree with you, but you must also understand this is open source code and XDA is a community driven site and we should share with another to make our devices the absolute best that they can be. One should be concerned if one is taking ownership for someone else's work or turning a profit, in the mean time you can rest assure your statement is valued.

A mod can remove this thread if there's a concern otherwise I'll remove once the dev makes a post. Nevertheless, the dev made it public posting it on dev-host for all.
p.s. - I agree with you, but you must also understand this is open source code and XDA is a community driven site and we should share with another to make our devices the absolute best that they can be. One should be concerned if one is taking ownership for someone else's work or turning a profit, in the mean time you can rest assure your statement is valued.

We do have a policy (XDA Rule 12) and it does not cover reposting anything you might find. It doesn't matter if it is for profit or not, if it is their work then they get to dictate whether to allow others to re-share it. Open source code does not mean free rein to do anything you wish with the code. I agree that it would be nice if everyone freely offered all of their work on XDA, but that seems pretty unlikely and unenforceable anyways.
Now, given that this ROM does not appear to have come from someone registered here on XDA, at least not with his dev-host username, I won't take it down unless contacted. I will move it to General though as it isn't your work.

mekaziah at the time of the posting I felt that I could possibly have a few more things worked out of the ROM & was going to share with the community or was going to share with a couple of developers as a beta.
