EDIT/UPDATE: File your complaint with the FCC over the bandwidth throttle;
http://esupport.fcc.gov/complaints.htm
Original Post:
Using AT&T and a new SGS2. I've had a grandfathered "unlimited" plan for 10 years @ $30/mo.
"Unlimited" by definition means 'without limitations, unrestricted'. I was getting over 700KB/sec download before the throttle, now I barely get 15KB/sec, it's effectively crippled my phone and certainly made GPS unusable. Calls to AT&T are pointless, they have a different definition of 'unlimited' and are telling me the throttle won't be lifted until my next billing cycle in January.
Two questions;
Does anyone else find this absurd? "Unlimited" is a very specific, non-ambiguous term.
And has anyone found a way around this?
Sent from my Galaxy II.
of course its absurd but there's no way around it
I'm not a lawyer but this seems like class-action material. It's false advertising, at the very least.

Just wondering, how much did you use per minutes of internet before hey started throttling you?

There's a thread in the Vivid forum discussing this. People are being throttled after as little as 1 GB. Can't figure out what their use of measure is. Calendar month? 1 GB is unacceptable. I said over there top 5% is likely a lot lower than people probably think considering tons of people on grandfathered unlimited plans probably use hardly any of their data. Smartphones are no longer for the power user. My dad as an Android phone and he might have his email setup, but I'm sure that's all the data he uses.
edit: They did find a way to change the APN to where you weren't throttled anymore though, not sure if that applies here as well.

That works only for LTE phones. They hit the Throttle on the LTE data, they can switch APNs to use HSPA+ data at full HSPA+ speeds. So they go from 30+ Mbps on LTE to like 0.25 Mbps, then switch to HSPA+ and get 6-8 Mbps.
In my area I get 2-3, at best on HSPA+. I use 6-8 GB on a normal month, as high at 10.5 one month. I have never been throttled.

I feel like I'm capped at 3 Mbps. No matter what it tops out at that. Kinda odd if I'm not capped.

3G and Faug G data speeds vary greatly by market. I think LTE is fairly consistent market to market, and in those markets the HSPA+ data is generally 8-11 Mbps.
Some people complain when they are throttled down to 100KB/s, something that's a good day for me.
Sent from my Galaxy S II (i777)
To answer those that asked, and yes, I admit this might seem ridiculous, but I did ~10.6GB in 14 days. Prior to that, I averaged 10-20GB a month with no hassles. With the new phone, the $0.10 Google market sale and a lot of experiementing, it was higher than expected with the new speeds. Still, "unlimited" is unlimited.
The notice I got came in the form a text, informing me that I should check their data plans (again, I have unlimited, why would I care?) and then a second notice that came in hours later - sometime around 4-5am that read:
"ATT Free Msg: Your data use is approaching the top 5% of users. Avoid reduced data speeds, use Wi-Fi where available. Visit att.com/dataplans or call 866-344-7584"
That's it. The warning came but I was already throttled and the "smart" part of my phone is effectively useless.
Read this story it explains how AT$T determines who should get throttled.
In a nut shell if you live in a area that has high data usage then the threshold is a lot higher then if you live in a area that has low data usage.

It doesn't say anywhere in your agreement you are set to get certain speeds. It also says all over that att will do whatever they deem necessary if they feel your use can cause detrimental affects on other users.

Made an update to my earlier post. My account on att.com reports that I did 10.6GB and was roughly half-way into my billing cycle.
Since their nerfbat hits entire neighborhoods (by design) it makes for some ridiculous scenarios. This **** was obviously derived by committee.
Question: Is it even possible to consume all of the data in your plan if you are restricted to 2G? No. It's not.
AT&T's plan caps can't even be consumed at 2G speeds, it would be fun to see a class-action against AT&T for failure to fulfill contract by deliberate act.
Scenario:
1) you use a bunch of data quickly to DL something in the beginning of the month.
2) AT&T flags you and demotes you to 2G for the remainder of the month.
3) At full 2G speed, you DL everything you can, but are only able to use up 2/3 of your paid data plan simply because it is not possible to use more than that with 2G in a month.
While you're stuck at 2G, your 3G-equipped neighbor is now in the top 5% and gets demoted to 2G, too.
Yes, I smell class-action.
Tried once more to get a rep on the phone, it's pointless. This is a direct quote:
"Sir, I realize you have an unlimited plan but we've placed a limitation on it."
AT$T use a different dictionary to define 'unlimited'. Even if they wanted to, nobody can remove the throttle until the billing cylcle ends. Bastards.

Technically you are unlimited, they're not completely shutting down your data. You can still transfer all day long, just at a slow pace.

I'm out in the middle of Idaho. I manually updated my PRL to 00001 to roam with 3G but I'd like to know how much is TOO much data usage that would cause Sprint to cancel my contract? I'm stuck here for another week and a half.
300 MB per month is where they reserve the right to drop you, but most of the time it takes several months of breaking that for them to flag you. If you want to be safe, keep it below 300 MB, but you could probably go up to a gig if you aren't planning on doing this long-term.

Off-network Roaming: The primary use of your Device must be for domestic purposes within the Sprint-owned network. Domestic means use in the 50 United States and U.S. Territories (except Guam). Sprint reserves the right, without notice, to deny, terminate, modify, disconnect or suspend service if off-network usage in a month exceeds: (1) voice: 800 min. or a majority of minutes; or (2) data: 300 megabytes or a majority of kilobytes. The display on your device may not always be on and will not indicate whether you will incur roaming charges. You can monitor usage online through My Account. Roaming is not available with single-band phones, or to customers who reside or whose primary use is outside an area covered by the Nationwide Sprint Network. Sprint may limit or terminate service if you move outside of the Sprint owned-network.

Post links much?
They claim it is unlimited. someone needs to flat out press criminal charges against sprint if they cancel an account for going over 5gbs. lol. so the CEO should go to jail for being a **** and a loser. and so on... Giving them a fine or trying to get money out of them is a waste of time. because the ones that make the choices are not held for their criminal actions.
TL;DR? I can't post the link, so google "Terms & Conditions - Sprint" if you want the whole deal. Per the aforementioned:

Make you you double check you bill because even though the website says that you have unlimited they will still charge you something like $0.50 a megabyte over 300MB
And that's why sprint got pissed off at you. They lose money when you roam off another carrier's tower's. That's why you only get 300 mb data roaming when they claim you get unlimited. Easiest way to lose your service wiith them. It's not illegal to flash your phone over to another carrier. That's what I would do. It maybe possible to flash over to Verizon, but you can definitely flash over to boost, virgin mobile, metro pcs and page plus.
I had an interesting experience with Sprint's customer service the other day... I had finally pulled the plug on them and switched to Verizon and the Droid DNA. I wrote a quick note to [email protected] telling them that I'm leaving because I still had no date for LTE in Milwaukee and I was sick of waiting without any information from Sprint.
I got an email back from a customer service agent saying basically that they hoped I would be back in 2 years to enjoy unlimited data.
So I called their bluff: I told them that I would like a signed letter stating that if I returned to Sprint in 2 years, they would need to honor my unlimited plan. Basically, put up or shut up.
Here's the response I got:
Per our conversation yesterday; I do assure you that Sprint is committed
to providing outstanding service. I understand the value of our
unlimited data. It is Sprint's hope to continue to offer unlimited data;
however our plans are subject to change and I am unable to determine
what plans will be available in 2015.
It was a pleasure to speak with you. I do hope you return to the Sprint
family in the future.
Thank you for choosing Sprint.
Sincerely,
Sarah B.

So, I leave it up to you to take what you want from that statement, but to me it looks like they are going to yank the unlimited data on their customers as soon as they get everything in place. Just my thoughts... don't shoot the messenger.
On a side note, Verizon's LTE speed buries the needle on Speed Test and the coverage is excellent. The quad-core DNA is the best HTC device I've owned. It's so nice to be done with Sprint.

No one really has unlimited data today. All of the carriers will cancel your service if you use enough data, unless of course you are paying per MB, even if that usage comes from downloading four or five ROM's directly to your phone each day and/or steaming too many movies. They just don't like heavy data users even though it's supposed to be unlimited.
Virgin Mobile is in the process of throttling 4G usage after a limit is reached and I would expect Sprint to do the same thing. My WiMax/4G coverage is pretty good (~8 mbps down and 1.3 mbps up) but we have no target for LTE in my area either so I feel for you and may be looking at an M7 or Nexus 4 with Verizon or T-Mobile when my contract is up in June as well.

I would definitely want to test Verizon's LTE against T-Mobile's HSPA+ in my area before making a decision, but at least those options are available unlike Sprint's LTE.

My wife and I share 4gb. In the first month we used 600mb. I've learned to leave Wifi on and let it tell me when there's a hot spot available. So most places, when I'm not driving, I'm on Wifi.
I encourage you to leave Wifi on all the time and run 3g watchdog or somehow monitor your usage and you might find that you use a lot less than you think you do.

I agree with you 100%, but WiFi is just as good using a Sprint phone as anyone else's. I'd prefer to have unlimited data, even if it gets throttled at some point, and not have to worry about tracking my usage. And WiMax is the closet thing to mobile WiFi so I'll just continue to use that until I get a phone that doesn't support it.
I'm actually considering a Nexus 4 on a T-Mobile pre-paid plan that has 100 voice minutes but unlimited texting and data, with 5GB/month of 4G (HSPA+) data degraded to 3G when that threshold is reached, for $30 a month. I could use VoIP for outgoing calls and save the 100 minutes for incoming.

For T-Mobile there is not supposed to be a limit on the 3G usage after the 5GB 4G allocation is exceeded, but as I said previously I'm sure that if your data usage becomes what T-Mobile considers excessive you may risk cancellation of your services.
Here's the wording in the T-Mobile terms and conditions that relate to data usage:
Permissible and Prohibited Uses: Your Data Plan is intended for Web browsing, messaging, and similar activities on your Device and not on any other equipment. Unless explicitly permitted by your Data Plan, other uses, including for example, using your Device as a modem or tethering your Device to a personal computer or other hardware, are not permitted. Other examples of prohibited uses can be found in Section 18. Protective Measures: To provide a good experience for the majority of our customers and minimize capacity issues and degradation in network performance, we may take measures including temporarily reducing data throughput for a subset of customers who use a disproportionate amount of bandwidth. In addition, if your total usage exceeds 5GB (amount is subject to change without notice; please check T-Mobile's T&Cs on www.T-Mobile.com for updates) during a billing cycle, we may reduce your data speed for the remainder of that billing cycle. If you use your Data Plan in a manner that could interfere with other customers' service, affect our ability to allocate network capacity among customers, or degrade service quality for other customers, we may suspend, terminate, or restrict your data session, or switch you to a more appropriate Data Plan. We also manage our network to facilitate the proper functioning of services that require consistent high speeds, such as video calling, which may, particularly at times and in areas of network congestion, result in reduced speeds for other services. Additionally, we may implement other network management practices, such as caching less data, using less capacity, and sizing video more appropriately for a Device to transmit data files more efficiently. These practices are agnostic to the content itself and to the websites that provide it. While we avoid changing text, image, and video files in the compression process when practical, the process may impact the appearance of files as displayed on your Device.

I suspect Sprint's policies are very similar even though they advertise "unlimited" data plans.
ramjet73
I agree that "unlimited data" is an endangered species. After all, any one cell tower's bandwidth is limited to the bandwidth over landlines. Unless a site is fiber fed, the bandwidth is limited to copper lines, which are limited by distance and condition of the plant. Inevitably, the bandwidth will be used up as devices get faster, and more people use wireless services. To sum it up, and without ignoring the carriers responsibility to provide cost effective service, "We have met the enemy, and he is us."
Only thing they care about is roaming. Don't roam and you will be alright. If yu use over 50gb a month, then you are doing something outside your phone anyway.
Verizon just reintroduced a new unlimited talk /text /data plan, $65 + $20 for one phone and it includes Canada and Mexico and if you autopay, you get an automatic $5 discount per month.
Free hotspot (10GB at 4gLTE speeds, then 3g speed after that per month)
Data MAY be throttled after 22GB in billing period.
500MB/day at 4gLTE then speed drops to 2g speeds in Canada and Mexico
It's actually saving me about $7/month over my old unlimited data + 450minute phone service.
I have never gone over 18GB in any one month, so.. I was finally convinced to drop my old unlimited data plan because I am getting more for less!
No idea how long this plan will be available.
Just an FYI
And no, I have no connection with verizon other than I am a customer.

I'm still grandfathered in with 2 phones on the old data plan, was wondering about the details of this new plan. Appreciate the details!
I average 20 to 40 gigs per month and pay extra for the Canada/Mexico data talk plan. The idea of being throttled down scares me and especially when most my data usage is through my hotspot. Think it's best to stick it out. It's funny how hard verizon has tried to make me change plans lol

They claim throttling only occurs if you use over 22GB, in the current billing period AND network congestion is occurring. However, they also say throttling will occur while using as a hotspot and you have over 10GB of tethering usage (in the current billing period). Both those throttle you to 3G speeds.
As to Canada, after 500MB in any one day, you will be throttled to 2G speeds for the rest of the day.
I too had a grandfathered unlimited data plan and a limit of 450 "prime time" minutes and 500 text messages. I never went over either limit. I use my RV 3 to 4 months a year, during those months use 12 to 16 GB of data using the hotspot (rooted unmonitored hotspot) other months only 2 or 3GB.
But..I have a son who lives in Canada but could only text from Canada for free, any other use was expensive.
So for ME, it was a no brainer. Lower my bill by about $7 but data, phone and text in Canada. And still get more unthrottled data than I have ever used.
I tried my hotspot a few days ago (same hotspot, not Verizon's standard hotspot app) and then checked by usage the next day. It showed zero tethering.
In your situation.. I'd be concerned about throttling too and wouldn't have switched.
But

I am still on the grandfathered unlimited plan. I am going back and forth about switching. I have 2 lines, one mine and wife has the other. We are both heavy data users users with each phone probably in the the area of 60gb or more a month. Switching over would save some money but she is concerned about the throttling. For me, most of my data is done at home so it would be be easy for me to use the home wifi which is probably just a bit faster than mobile data but she uses a lot outside the house. Decisions, decisions...
But does anyone know if they will be throttling the grandfathered unlimited plan as well? If so, then it is a no brainer and the switch would be the better option...

They have always said they will throttle the heaviest 5% of users and there have been recent posts on the internet that the heaviest grandfathered unlimited users are being forced off the unlimited plan, as in giving them a date to select another plan or lose all service. The reports I have seen were from users who use over 90GB a month.
I *suspect* they will continue to force grandfathered users to switch and/or raise the fees another $10 or $20 a month like they did 6 or so months ago.
Nothing official.. But I have read that grandfathered plans now are less than 1% of the total number of users.
Bottom line.. You roll the dice and take your chances.
