So, I bought a photon on Craigslist. I'm a firm believer that there are good people in the world as well as bad people. I spoke to the guy on the phone and he was very cordial. When asked, he told me the esn was clean, and that I could call sprint and verify. Upon delivery, his sister told me to call sprint to verify it's clean. I told her it wouldn't be necessary. I figured someone who is out to scam, isn't going to risk losing out on $250. So with that done, I went home. I hopped on checkesn.com and it told me the esn was not cleared. I was in shock, so i decided to sign onto sprint. After some research, I found out that you could figure out if the esn was clear by trying to activate it through the web interface. Same result returned. I called sprint and they told me that the phone was still attached to the account and that I had to ask the owner to release the phone. After I texted the guy, He said it was his mistake, and that he must have given me the wrong photon. He said he would call and have it removed from that account. He texted me back saying that it was cleared. 2 hours later, and it's still not cleared. I don't think that he would go through the rigamaroo of responding to me, if he wasn't planning on resolving this. Now its starting to seem more and more like I'm going to be stuck with a photon for a paperweight... sigh

Maybe it's not his fault and the carrier screwed up. Before jumping to conclusions, I would find out as much info as possible, then if not satisfied, try asking the guy if he'll give you a refund. No need to be "vindictive", that'll only lead to more trouble. Especially if it's not the guys fault. Sounds like he has been trying to help and if he were trying to scam you, he would ignore you. And after all is said and done, if you don't get it resolved then chalk it up as experience. There is some personal responsibility in buying from sites like craigslist and ebay. You stated that the seller told you to call and check the ESN first and you declined. If you would have done so, you wouldn't be in the situation you're in. Seems the blame should not be laid on the seller in the end, but on you for not doing your due diligence.

Sadely, I'm with stonesaber, and trust me, Sprint's computers are not the top of the litter. Take it to the store and see what happens.

It's probably attached to an account with a balance. If it isn't cleared, you have grounds to charge him (obtaining property under false pretense, a felony). Perhaps remind him of this.

I wish I could. I tried calling him this morning to let him know that the phone was still attached to the account. His phone is disconnected. Now I'm starting to find more reasons to act like a neanderthal. Can anyone here tell me if there is a way to find out the balance or status on the line that is attached to this phone?

Did you get it from his house? If not, file a police report. Be nice if it could be resolved without them involved, but I don't know if you can.

No, I met with his sister at a public place. I just called her and she said that she has another phone connected to the account, so this one should not be attached to the account. I read somewhere that you have to wait something like 30 days before you swap esn's ( Don't recall if this applied to vzw or sprint). She said to call sprint and tell them it was a gift, and I wanted to manually activate it. She said if that doesn't work, she would switch out the phone with the one that they originally intended to give me. I just feel like when I try to call her back, her phone will be disconnected as well...
Worst case scenario, I can sell it to someone overseas for them to use with their sim chip... Don't know if anyone would want to pay $250 for it though.

I'm starting to see that. I guess I shouldn't have faith in humanity. Out of curiosity, I atttempted to make a phone call with the phone, and it connected me to "Sprint Finance Services", I hung up the phone...

Since it's connected to an account, it'd be easy for you to get that money back via court. Also - Since it can be used on GSM networks, you could configure that and sell it as an unlocked GSM device, recoup some of your losses, if not all.

Now I know... Stay away from Craigslist... I called her back, and she said she would get it squared away in an hour. What I find peculiar is that she called the phone she sold me, and apologized, and said she would get it disconnected, if not, she would meet me to give me another phone. I told her I would call her back at 12. She insists that she will give me another phone, should she not be able to remedy the situation with this one. Fingers still crossed.

I hope it works out for ya. Be calm and let her know that if it's not resolved one way or another legal action will be required.. this kind of crap happens all the time. People are bums.

My faith has been restored!!!! She called back as promised and said the ESN should be good now. Sure enough, I checked it on checkesnfree.com and it says its clean for activation!!! I went on sprint.com and attempted to activate the phone and it went through instead of giving me the normal error message. So ecstatic!!!!

Thanks for the reply nemanracing, but sure enough, everything has been remedied! One question, which hopefully you can answer. Now that the phone is clear and good to go for activation, is there anyway Sprint will " change their mind" and deactivate the phone? I don't know what this lady did, but it says the esn is clear. Just want to make sure the bill doesnt get tacked onto my account some how.

You definitely won't be held liable for any balance accrued by another individual. If it activates, you should be good to go.

He probably had a throw away phone. After all, didnt you say that he sent his daughter to deliver the phone? Perhaps so that you did not actually see him? Just sayin, if I were selling something like that my daughter would be the last person I would send to do it for me.

Almost became a proud 3D Owner

Purchased a brand new EVO 3D off a guy on craigslist who swore it was all good. Called Sprint only to find out it has been reported as Lost or Stolen.
Guy of course will not return my calls now. What I can't believe is I asked if I could return the phone to Sprint so they can handle it, if it was stolen to return to the original owner or if reported lost it can now be found. They simply have no policy in place that allows for this.
So I'm basically screwed and have to try my luck selling a bad ESN phone on ebay (of course I will clearly list it as BAD ESN).

Maybe try calling back and talking to another associate. Or taking it to a local Sprint store. Or posting an ad somewhere, or with the local police department.
What an honorable thing to do though! I hope if I ever lose a phone, someone like you finds it.
That sucks bro, i know you can flag bad esn phones to metro pcs and cricket so you can market that in your eBay ad and still get top dollar for the phone. Best thing you can do in the future is have the seller meet you at Sprint saying you won't pay till its activated on your account or at least until the Sprint store confirms that it has a clean esn

You should have called Sprint while in front of the guy and asked the rep if the phone was good. They will tell you if it has a good ESN or bad. When I bought my 4G, I called them right in front of the guy I bought it from. Just a FYI from now on.
Edit: I guess that only works if you meet them to pick it up. I would never buy something off Craigs List any other way. The few times I have purchased something from someone on Craigs, I met them in person.

I got a call back from Sprint to ask about my experience with the representative (who tried everything to help me, even told me about the buyback program that I could try) and I asked again and was told unfortunately they simply have no procedure/policy in place for such a thing.
They basically just take it as a loss and thank you I appreciate that. I would love if I lost my phone that someone would try to return it too so I tried doing right by whoever had the phone stolen or lost. I believe in Karma, the bastard who ripped me off will get his dues!

I have bought several phones on craigslist and sold them too, I usually call sprint and activated before I give then the money and I do the same for the other person, what a douch the dude that did that, but you can still sell it on ebay for a few bucks for cricket

Google reverse phone lookup. You might be able to get their address from the number like others said. That sucks though..

Thanks everyone for the support! I really appreciate it. Turns out he was using a textfree service number so no luck there; not that I was going to confront him. Rather lose some money then the possibility of the guy carrying a weapon and using it against me.

Thanks again for all the kind support though guys, I feel a lot better and I already managed to sell the phone on ebay. Made sure buyer understood Sprint would not activate it and he is none the less happy with his purchase.
What a bummer man, I'm sorry that happened to you. I use Craigslist all the time to buy and sell phones. Never had s problem yet but I always get the esn before ill even meet the person. But for sure you can flash it to metro pcs and sell it that way. I'm in Detroit and people will post that their phone has a bad esn and people still buy them all day long..

Maybe you can go into the EPST and see what the previous owner's email/phone number was. Or maybe some files on the SD card will give you a clue.
Or post an ad in the found section of Craigs but say you'll only give it to the person who has the box with the IMEI number on it.

Definitely, call the police and report this. Since it is a new phone, you may be able to get a felony charged to him. Isn't theft of items over $500 a felony? The phone new is is $550 bucks. That is a felony. Please do it. People like that do not deserve any ounce of niceness, pity, or the right to vote. Please, please report him. I know how you feel. I was scammed once like this. A guy my sister knew(not really a friend just someone she knew) said he needed money pay rent or he was going to be evicted and he could trade a Wal-Mart gift card for the cash. He had a $300 gift card and needed $100 bucks to pay rent. So I thought why not because I can check the balance of the card before I give him the cash. And that the gift card is only good to him if he buy something at Walmart and not to pay rent. Plus my sister said he was a cool guy. I meet him and he dials his phone on speaker to check the balance of the card. The balance on a card comes to just at $300. So, I'm like awesome I've helped someone out and got a nice deal. I get home and start shopping on Walmart.com for a TV I've been wanting. I go to check out and the card says there's insufficient funds available on it. Turns out that the guy switched the cards. I was pissed. My sister found out that he had a drug problem and he had done this to other "friends". I reported him and he was arrested. He had done it to at least 4 other people. I should have checked the balance myself, but since my sister said he was cool, I thought hearing it from his phone was enough to be legit. Being scammed does make one feel dumb, but they have practice at doing it. They make it their job. And we all tend to get good at our jobs. Please report him. I feel for you, bro. Good luck.

I hate to hear stories like this. I have followed up on (3) incidents involving cell phone fraud/abuse/theft and can verify (1) arrest from it. Cell phone companies will take the loss in lost/stolen equipment but there is no limits to what you can do personally in exacting justice on these criminals.

I don't know who/what/when/where or how, the power button on Photon is missing? I have never dropped my device, I don't even toss it onto bed!!! I hope I dont get a new phone because it took me over a WEEK, 10 - 14 hours a day to get it like I wanted it!!!

Now: I'm a pretty easy going person, i rarely get upset at anything, life is too short. I go to Garden State Plaza to Sprint store to speak to one of the Brightest Minds in America. Her nametag says "Manager" so I know I have the correct person and I'm going to get top notch service!!! I tell her its broken, the power button fell off! The first thing out of her mouth was "Have you had the phone for 30 days or less?" (I will not insult you guys, phone came out August 1st, therefore, this chick cannot count!) After this hiccup, she ask where I got it? (Again, I will not insult you. I treat my toys well and I have insurance, I dont care if I got it in Mississippi, it says "Sprint" on it, you see my insurance on my account, give me a working phone!!!!) After 10 minutes on the phone with "whoever", she tells me I need the box because they need the IMEI #. ITS A BOX, I DONT GIVE A RATS...............I'm going back with box and phone at lunch.

I will make this short and sweet, I got a new Photon. I'm pissed at the way I got it, but I got it. I could not figure out how to restore from my backup, so I started the pain staking task of putting it back like it was.
Now, I will bring some comedy to this thread!!
If you go to the Evo forum, the Fuze Forum.......any of them. Everyone can tell you I'm anal about my toys. If your here, you likely are too! My phone has special mouse pad to sit on everywhere.
I return to the same store with a guy I work with that used to do mobile support for our company. I talk to the same manager, she asked me the same 30-day question. I just turned around and looked at Will and srugged my shoulders. She then asked me to taked it to the technicians and signin. These 2 clowns come out and look at the phone, then then again ask me the 30-day question! The Photon is your flagship phone, its IMPOSSIBLE for me to have had it longer than 23 days!!! OK, we will replace it!
After 45 minutes, I get the same manager back. She tells me she needs to turn it on to make sure I did not root it. I have rooted/flashed likely 200+ times. Each one I'v done contain 4 things. Disclaimer that it will void your warranty, Instructions on how to Root/Flash, another Disclaimer that BEFORE you return to your carrier, and Instructions on how to un-root/Un-flash? One would think if I'm smart enough to root/flash, I would be smart enough to un-do it? Personally, I dont think she would know if i did or did not (Unless she noticed something like 'Sprint NASCAR" was missing?)
She then preceeds to tell me "This is clearly physical damage?" Again, I just turned and looked at co-worker. I asked her and the technican to find one single nick on that Photon! They tell me they cannot, but it was likely dropped. I say BS, show me.
I got tired of playing and had to get back from lunch. It dont matter, I have TEP and repair, you can't repair it, give me another one or similar phone per this $8.00 monthly TEP. She tells me physical damage is not covered. I say show me? After playing on her computer for 15 minutes, then a phone call, she gave me a new Photon.
Only at Sprint!!! Sad thing is, next year she will likely get promoted to CEO!!!!

What was the address of the store? Did you get any part of her name at all?
EDIT: Got it, Garden State Plaza store. I'm going to escalate your experience to help improve future customer interactions. I'm not sure if this is a Sprint owned store or a 3rd party, but it shouldn't matter. You should be treated better than that.

It's the one above the food court (there are 4 Sprint Stores in this Mall. They have the one I mention on Second floor above food court. In the food court they have a 3D/Photon Setup. They have a kiosh outside JC Penny's. And they have a store on the other side of Macy's!)
What I think is, Honestly, each of these stores are owned by different individuals. Each store likely get's a quoto # of Photon's to sell. The Store by Macy's told me I had to take it back where I got it, likely because it would cut into the number of phones THEY had to sell. Where I got it, more or less, just gave away $600.00!!! Just my opinion!

You're right. I'm pretty sure that's a 3rd party store, but they should still be more helpful and sound less clueless. Sprint is working hard to overcome a bad reputation for customer service and things like this don't help.
I'm glad you finally got resolution, but it should have been handled in one trip. The whole thing about the box was a joke. I'm betting she was hoping you would hit a different store when you came back

OK, I will attempt this ONE more time!! I was NOT returning the phone, I just wanted a WORKING phone. That's all I wanted. It was clear to the 2 technicans that looked at it, and it was clear manager the phone was missing this button. Additionally, this is SUPPOSED to be "Sprint's Flagship" phone. It was released August 1, 2011. The 30-day Risk-Free Guarantee should have never been a question as it's impossible for me to have owned this phone for more than 23 days. Next on this, I pay for insurance & equiptment repair to cover this, so it should not matter if I owned the device 2 days or 50 years. I was told by the Manager it was clearly physical damage. I asked her and her 2 technicans to show me ONE mark on that phone? After an hour, the phone was replaced.
Next, lets go back to my bill. CDMA Phones (Sprint and Verzion) do NOT work in Europe (well until this phone. All AT&T and T-Mobile work globally as they are GSM), If you looked at my account as you stated, you can see that 1. I do not have International dialing on my account nor did I enable it. Therefore it is impossible for me to make a International call. Secondly, in order for me to use THIS phone outside the US, I have to call Sprint to enable me in whatever country I am traveling to, therefore I could not have made those +44 (which is the UK by the way!) calls. I think we can both agree this HAD to be an incoming call (like all the rest of them!) In the last year this has not been on my bill!
Lastly, since I'm here, If you look at the attached invoice, my upgrade is $0.00. If I look at my current bill, it $19.08!!! Therefore, that charge should be removed from my bill!

Honestly that exchange is a little hard to follow. Did you mention the billing problem to the rep in the original submission?
I think that maybe she was trying to solve a problem when what she should have done was escalate the issue to an area manager. Did you get the billing issue fixed?
I actually noticed a Photon at the store with the power button not attached. Believe me, I will return mine in the event that falls off.
Thats like receiving a phone with a glued on screen and being help accountable if that glue wheres off and my screen is no longer attached.
To me it sounds like alot of people talking about policies and processes that they have NO OBVIOUS idea how they work.
Lets start:
First...the Evo 3D is Sprints "flagship" phone. Look up the definition if you need further assistance.
Second...ALL returns, regardless of 3rd party or Company owned require the original box when returned or a fee will be accessed. Its in your contract you sign. Try for starters to read it thoroughly before yelling and screaming at the ones of us that work for Sprint and can help you if you help yourself!
Can this be overridden? OF COURSE...but if your attitude sucks, chances are youre not going to get the "customer service" you think you are deserved.
Third...as for TEP, its Total Equipment Protection, not Insurance! BIG DIFFERENCE! This is to assist you in the cost reduction of a new device if something happens to yours. Again, reading the TEP agreement, physical damage is noted as obvious damage or missing components. YES I know, its a flaw in the design, BUT UNTIL Motorola releases a statement to Sprint verifing that this is a "known issue" with this device it will be looked at as physical damage! (Return a car to a dealer after 2 weeks with a missing door handle and see what happens...just sayin)
Fourth...its not as easy as walking in and saying "I want a new phone. Give it to me now". Again, this goes back to your TEP agreement and Sprints 30 day policy. If within 30 days, its exchange/replaced. Now, if you purchase at a Company owned store, you can return it at a Company owned store ANYWHERE. However, if you purchase it from a 3rd pary dealer, you must return it at one of their locations. This can be overridden thru customer care, but you will get NOWHERE in store. This is just the way this process works.
Fifth...understand that the person that you are dealing with in store has all the control, and its usually based off of the attitude the customer has. You yell and scream and act a fool, Im not doing **** for you. Flip side, youre calm and understanding of the processes Sprint has in place, Im gonna make SURE that you are taken care of. (Free accessory, bill credit, something...)
Hope this may lay to rest those that are only customers that think they are the CEO.

To be fair I have also walked into a sprint store and was mistreated by a person from the get go. I did nothing wrong or had any kind of bad attitude with them. I just knew the policies better then they did. Luckily a manager noticed the situation and took over helping me.
I do agree tho that some people do have horrible attitudes on both sides. Sad thing is it is those events that get blasted online. In your case I completely understand. The warranty question was ridiculous.
Also I have had beter experience at a corporate store than a 3rd party one and I always askif the store I am going to is corporate or not. I stay away from the 3rd party stores.

Htc amaze scam

I purchased a phone from craigslist didn't know that t mobile had a imei system and didn't have t mobile service at the time bought the phone with case phone looked brand new etc i activate phones not working turns out bad imei.
The good news is that i have the text from seller and a tmobile rep told me that he is a tmobile customer i asked if he could check if the phone was purchased on the account to check if it matched up and he told me he couldn't give me anymore information anyone know how i should go about this situation with the police?
Nothing you can do except using the phone as an ipod.

Probably not much u can do especially if he included the words "as is" anywhere in the post, but if he didn't you can probably go to your local police station and file a police report and take the guy to small claims court......I think anyway.......you might want to ask Binary he's a cop he would know better then me.

Well he can report it to his local police station but there's not much they can do. This is actually more of a civil action unless you can provide reasonable doubt that the seller is selling stolen merchandise. And if the post says "AS-IS" or anything similiar then you're SOL. You can try to contact Craigslist and report the seller for selling stolen merchandise. They might cooperate with you to take the seller to civil court.
That's about the best that you can do.

Thanks everyone who helped, Binary i know that normally with craigslist stuff if you get scammed its pretty much on you. But the guy told me he got the phone off a upgrade and decided to stick with his old phone therefore he is lying. I also know that the number he was using to do the business with is linked to t mobile which leaves his information for the police vulnerable. Luckily my mom works at a high school and i have access to a police officer. Since you're a police officer i was wondering if i had information showing that the phone he sold me is directly linked to his account and shows that he said the phone was stolen/lost i can report him to asurion insurance and get him in trouble for insurance fraud at least. The one thing i was wondering is if he would say i stole the phone from him but i have the box with unopened accessories and text showing we were meeting up etc.

I'm actually thinking that did the insurance fraud thing. He likely called Asurian to tell them that he lost the phone and would like a replacement. Asurian then puts the IMEI on a black list so it can't be activated again since it was reported "Lost/Stolen" and shipped him another. He then sold it to you. Now without a Bill Of Sale it's all on you. If you have the text message then you have his number. Contact the seller directly and inform him. Best case scenario he did not actually with full intent attempt to sell you a stolen phone. He may be able to call Asurian and say that he had found the device and they might then be able to remove it from the black list. However they will probably want the replacement back. The most that you can really do is threaten him to call the police... but this is really a civil matter. Just because you have the box and phone number doesn't mean anything. Here's an example. If you were a criminal and robbed someone's house, took their tv, computer, jewelry, phone, box for phone, etc you can also take their identity since almost everyone has bills laying around. At least mail. So they can have your name, phone number, address, IMEI, original packaging... whole nine yards. Does that still prove that you know eachother? Can he still use that to prove that the sale was legit? No way. This is a civil matter and not so much criminal so you're not going to get much assistance from the police.
My advice, contact the seller and tell him that you need ALL of his information. Name, address, contact information for his account, etc and tell him that you have to use it to get his information removed from the black list. Try to get his DL number too. Tell him that the insurance company requires a copy of it to remove it from the list. Make up something clever like that. Then use that information to file for court. It's up to you if you want to try to settle it in court or not but it's your best bet. PD has a lot more to worry about than Craigslist scams and unless the insurance company or TMobile wants to provide informatino willingly to a law enforcement official. They may or may not because they are under no legal obligation to comply unless it's ordered by the court. But again... that's really up to you.
One other option is to consult with your local prosecutor's office. Laws and procedures vary state by state, and between jurisdictions, but in Florida a lot of jurisdictions will operate some type of citizens dispute mediation program using volunteer mediators.
The idea is that by bringing both parties to the State Attorney's Office they will reach an agreement, or the more guilty party will make things right, and actually follow through on it because they believe it has a little more authority attached to whatever resolution is decided upon when in reality it may be an incident that is more civil in nature and could never be proven beyond a reasonable doubt in criminal court.

What Binary said makes a lot sense otherwise not sure what else "Bad IMEI" could be implying.
If this is true, and t-mobile blacklist the phone for activation, may be you can try unlock and see if it works under other carrier such as AT&T? If works, you can try switch carrier or sell to AT&T users.

They will scare the crap out of the guy and will get your money back...I got about 8 years ago on ebay when it wasn't so safe, someone sold me a laptop but it was just a poster of a laptop. Problem was in the description it never said laptop, it said item and it was basically a poster of laptop with its specs. so what I got was a laminated poster of a laptop for 1100 dollars. Subrogation services is a good thing. look into it.

Well i was switching from sprint to tmobile back in the day you could pop a sim in and thebphone would just work even if lost or stolen i guess things changed and i got hustled im not to worried im sure i can get it unlocked and make atleast the 330 i spent back its just that i signed a 2yr contract got scammed and want him to face some sort of consequence

U can never unlock an imei blacklisted phone.
tmobile block the imei number of the phone, when the phone ever was reported stolen lost or the guy asked for an exchange and never return it, there is no way to unlock the imei number so you are screw,
i say get together with some friends find this guy a kick his ass!!

I was informed i could unlock and use on other networks just not tmobile with a bad imei? i was planning on selling on ebay including the info that it has to be unlocked and switched to anyone besides tmobile.
I signed the contract because i have a 14day period where i can cancel without a fee i figured i would find a way to change the imei if worse came to worse.
Last i was told by a t mobile rep that they were changing my imei and it will take around 2hours.
I thought it was as simple as putting in your sim card? I guess tmobile is getting with the times.
If the guy never used the phone asurion would never do a claim for him! They have to see the imei active for them to file a claim!
And it is possible to unblock a imei asurion can do it.

[Q] Is my issue worth trying to get a replacement Note?

Hi, all.
I'm a recent Galaxy Note convert. Migrated from years of glitchy and crap service from Sprint, and also a defective HTC EVO 3D. I absolutely LOVE my Note in ceramic white. However, I have had a couple of initial teething issues that I don't know are actual "problems," or just what to expect with a new Android device.
My Note is pretty much flawless most of the time, but there are instances where I've had random reboots, prolonged freezing up of the device (like when selecting certain live wallpapers and customizing their effects), and other times when transitioning from one program to the homescreen, and my phone will lag up and the icons will disappear off the screen and slowly reload a few icons at a time until everything is there, again. Also, I just realized that sometimes when I have alarms set to go off, they won't wakeup my screen. The alarm will go off but the screen will remain off. Other times the alarm will wakeup my device and turn the screen on.
So, my question is... should I be concerned and demand a new phone from Best Buy Mobile, or are these normal issues and nothing to really worry about? When I went to Best Buy, yesterday, to try and get a new phone, they were really apprehensive about it. They told me that AT&T would not allow them to replace the phone if the issues couldn't be replicated in the store (of course!). The rep did say some valid things to me about what could be causing the issues, but the whole random rebooting thing is what really has me concerned. He told me the phone was so new and that software updates have really came out yet to address any type of initial issues. Do you all agree or should I really try to get a new device??

I would get it replaced. I have not had a random reboot in both the stock rom and the SauROM custom rom. I know many others here, do not have random reboots. Something is definitely wrong hardware wise.
No random reboots or freezing on mine.

If you're getting random reboots on stock rom with no OC, then definitely go and demand a new phone. This sounds like faulty hardware. I've never had a random reboot, even though I am undervolting and OC'd to 1.83Ghz.

Thanks for the advice. Yes, I am running stock ROM. So now it seems like I'm having two problems... the first being that literally no store in my immediate area has anymore ceramic white Notes in-stock and the second being the unwillingness of BB Mobile reps to replace the phone. Today ends my 14-day trial with AT& (even though I have 30-days to make a final decision) and I'm limited on how much I can do today due to an engagement I must attend, tonight. Does anyone have anymore suggestions on what I can or should do? Thanks for much for helping me sort through this. I knew that random reboots didn't sound right.

The other stuff you mention (laggy screen transitions and such) seems to be par for the course where just about any Samsung Galaxy phone is concerned, to differing degrees on different devices, but there's zero reason why a brand new device should be locking up and powering off on you, unless there's more to the story.
In either case, dump it and get a new one.

Thanks. There's no more to the story. Haven't really played around with the phone much or modified anything. Anything modifications I've done have been 100% stock. I guess I'll have to try and get the black/blue Note and before my 30-days or up, hope to swap it out for another ceramic white. Considering this wasn't my fault and BB gave me the run-a-round.
Do what you have to do, but get that sucker replaced. If you have to raise your voice with them and tell them they sold you faulty hardware and you want a replacement or a full refund. If they say no, tell them to get their boss, if that person says no, tell them to get their boss. Eventually they will say their boss is not there, at that point tell them to get the DM (district manager) on the phone. Someone will bend and give you want you deserve, that's the whole point of a return policy. Honestly if they did absolutely ANYTHING but give me what I wanted with a smile on their face, I would demand a refund as they have not erned my money. Take that refund and go to an ATT store or go online and buy that phone. I have had to take the "get your boss" route several times when they tried to give me the run around and I know I'm right. Once someone tried to tell me that they wern't aloud to call/contact their DM (this was a radio shack), so i found called another radio shack and just asked "whos your DM...ok and I need to contact him, can I have a number" and about 5 minutes of hold I had their number and called him directly to tell him the BS I was dealing with. At some point you will get the guy who isnt taking the return personally and knows his job is to smooth this crap out, simple as that.

Thanks for the excellent response. I just returned from the BB Mobile store I purchased my Note from. Even though I was told BEFORE I came that they had ONE ceramic white Note left... when I got there, I was told not only did they not have anymore white Notes (and haven't had any for a few days) but they were completely sold out of black Notes. I was then told to "factory reset" my phone, as a "be all to end all" solution. I feel so exhausted. I'm scared to ask for a refund and then go to an AT&T store and AT&T tells me they won't approve me for a line of service. I know it's most likely improbable that will happen, but you never know. I just don't want to be locked into a contract and then they have the ultimate freedom to not work with me. But what you said makes a lot of sense. I wish you had posted your response before I went to the BB Mobile store. I really don't want to take a second trip there, tonight.

I understand man, its a chore to deal wit hthis crap. I do not know how the deal between ATT and BB works, but if you have a ATT store around maybe give them a call and tell them about what your dealing with, or hell call ATT customer service and tell them that they sold you a defective phone and you're just trying to get a new one. Wiping may actually help, but who knows. Your on a time crunch, I'd be more aggressive with every passing day. Maybe someone here can shed some light on the relationship between the two entities and if there is anything ATT can do.

Thanks again for all of your help. I was actually thinking about calling AT&T and saying what you suggested. I think I'll give them a call when I'm done with my engagement. Again, I appreciate all of your help and suggestions.

A little off topic, but what did you undervolt to? I am running at 1.83ghz right now, and am curious what you undervolted to. Anything to save a little heat from forming and battery life for this thing
*UPDATE* So I just got off the phone with AT&T customer service. Now, grant it, this is only my second experience dealing with AT&T customer service and they were probably bending over backwards for me because I am not a customer locked to contract... but I have a very pleasant and satisfying experience with AT&T. Not the horror stories I've heard online. I talked to two different reps, one regular rep and another in the warranty dept, and both were helpful, knowledgeable, and shutdown all of the lies Best Buy had told me.
Both reps said they had no idea why BB was being asses about giving me a new phone. The rep in the warranty dept went much further, and apologized to me for all of the troubles they put me through ... and specifically stated that she had no idea why BB didn't simply give me a brand new phone, as that's the whole reason AT&T has the 30-day buyers remorse policy. She said it didn't matter what the reason was for my wanting a new phone, I am still covered under the 30-day policy, and BB should have simply given me a brand new replacement phone.
The final recommendation was since I technically bought my phone from BB, normally the policy would be I would have to get BB to honor AT&Ts policy and give me a new phone. But, because of all of the lies and run-a-round, AT&T recommended I go to an actual AT&T Store and they should pretty much be able to give me a new Note. AT&T setup a time to call me on Monday, to find out if I was able to get a replacement phone. They notated my account, and they said that if for some reason I wasn't able to get a new phone at the AT&T Store, the warrant dept would send out a new phone to me. A bit of a hassel, but overall it seems like my issue will be resolved (I hope!).

I was fully expecting AT&T to confirm what BB had told me, but to my surprise, they said I was entitled to a new phone and should have been given one. I ended up going to a Best Buy Mobile outlet and an actual Best Buy Store. They all claimed they were fresh out of any Notes. One of them told me they had one in-stock, but when I got there, I was immediately told that was incorrect and they had no more. Called another BB in my area, they were supposedly fresh out, too. If there's any good news from all of this, it's that the Note must apparently be extremely popular! Either that or Samsung shipped very limited quantities. At any rate, I can't wait til BB customer service center opens, so I can cancel my insurance with them. I'm also taking back my Galaxy Tab to BB. I've barely used it since getting the Note. If I do decide I need a tablet, I'll see what the Galaxy Note 10.1 is all about.

I am doing battle with AT&T right now myself. My situation is with my discount. I qualify for a stack of different discounts (can only have one though) and Everytime they "fix" my account I end up gettings texts telling me to call this number and verify my discount. When I call they tell me they need me to send them more paperwork. Im still in my 30day window, but barely, so I'm going down to the store tonight with box and receipts and telling them to have it fixed while standing there or refund me, no other options, no wait and see if this worked, no email BS. Either it works or it doesnt, simple as that. Im hoping I'll still be around this forum with my note and not another section of XDA with a new carrier.

I hope you get this sorted out. Discounts are a huge thing. I don't even know if I qualify for any discounts. With Sprint, they made it sort of obvious to find out what discounts I was eligible for. Doesn't appear to be the same with AT&T. I guess I'd have to do my own homework.

$500 paperweight?

So, a week ago I bought an HTC One from craigslist. We met at a T-Mobile store so that they could verify the phone was clean and able to be activated. They said everything was clean and safe to buy. Phone was working great for a week and then out of nowhere earlier today all the data and cellular service just turns off completely. I try turning it off & on several times, toggling airplane mode off/on, etc. etc. Finally I go in to a T-mobile store. After 30 minutes of turning it off & on, changing the SIM, calling corporate, etc. eventually they tell me that the phone was reported lost earlier today and is now blocked.
They tell me there is nothing they can do.... am I really just out the $450 now? Is there anything I can do??? What's the point of them verifying or checking anything if this can still be done? Any help or suggestions please!?!?
The only way to get it taken off the list is if the original phone owner calls in and says it is not stolen. It can be used with AT&T but none of the carriers that use Tmobile.
What your seller probably did was make an insurance claim. Get a second phone for $175 then he never returned the old phone sold it to you made $325 and then you get screwed.
Happens a lot more often now that IMEI can be blocked since march.
If you can get a hold of the person who sold it to you and be like wtf

If your seller was the original owner, then he is committing fraud if he has later reported it stolen. Check with the seller, and if you don't get a good answer, call the police. If the phone is stolen, then you need to call the police.

You think the police are really going to do anything about this? I kinda figured that would be a long shot. I'm guessing if I can find the seller's contact info they either won't answer, will hang up on me right away, or maybe even change their number if they didn't already....
To me, what I can't understand is how T-mobile doesn't have a better process that is more controlled. The IMEI should be tied to an account/owner and only be allowed to be activated on another account after transferring the ownership with the owner's consent. This seems like a pretty spotty process without any kind of controls in place.
Really don't want to be out half a grand....
Unfortunately I don't see any process like that anytime soon probably minimum ten years. That's what GSM is all about freedom to get a phone anywhere anytime. It is unfortunate that this happened to you. Happens very frequently especially within first fee months of phone launch.

The police report may not help you, but eventually it is quite possible that it will get the perpetrator into a lot of trouble - maybe keeping them from hitting someone else...
wait til all the big names start sharing the IMEI blacklists.

I called T–mobile myself a bit ago and just explained what happened. Apparently the lady put in a request to unblock it. She said it will take up to 48 hours to get it unblocked and to power cycle my phone pull the SIM out and try to make a call in 48 hours. Not sure what to think about that.... I guess I'll just give it a day or two and see what happens :/ From the research I've done it sounds unlikely they'll unblock it but I will stay optimistic.
SIDE NOTE: I found the sellers phone number and the text string of arranging the purchase. Think I should contact authorities or T-Mobile with the info or just try calling them directly?
If nothing else doesn't work, you can sell it to an Canadian or foreigner... Otherwise good luck...Did you ask for the receipt?, because when I bought my t-mobile htc one, I asked the seller to sent me a receipt.

Haha yeah I understand what you're saying and that you're not promoting me doing the same thing that was done to me. As a backup plan if nothing else works, this device could be used on AT&T right? I recently came from Sprint so not real savvy on how the SIM card / GSM networks work yet. Would I have to get the device "unlocked" to use on AT&T or a different GSM network? If so, could anyone point me in the right direction on how to do this and/or how much that costs.
Att and tmobile share imei lists.
Take that text string to tmobile. If the number that Texted you about the se is the number on his account. They can cross reference your phones imei to his number and use those texts as proof of purchase and help you.
I work at a store and if you came to me with this info I would unblock it for you....just sayin

You would also get fired for doing something stupid like that. You need to read up on the process of unblocking phones. Serious note, dont risk your job over something like this. Its not worth it, plus that phone is property of asurion once its reported stolen.

Actually I wouldn't be risking my job at all and there is a very strong possibility it would get unlocked. in circumstances such as this a rep can approach his manager with it and the store manager has the ability to call customer care and request the unblock. I would not be unblocking it myself

Well there is your lesson learned, Don't buy phones from Craigslist! I actually in the past had that happen but on a iPhone 4S and well it actually got blocked 3 days later and AT&T said it was reported stolen. So From there on I either buy my phones on ebay or just do some AT&T loopholes to get a brand new HTC One which I did and pay the new activation price for it

Thanks for the reply. Is that the number for Assurion? The store manager yesterday called them too and they were completely useless and just said to talk to T-mobile.

Why not learn a lesson from it and sell it to get the most of it ? Thats what i did in past
You can sell it on eBay say it is blacklisted at least get some money back.
Buddy of mine lost his phone made a claim. Then found his phone the day he got the new phone he called asurion for instructions on what to do he sent his new phone back they received it and got his money back in about ten days total. But they never unblocked his current phone that he found again. Here we are almost three months later his phone is still blacklisted and did nothing wrong. Called Tmobile at least ten times they always say 48 hours and doesn't do anything so he just gave up its a paperweight.

So I went over to Ebay and I see there is an HTC One with a T-mobile blacklisted IMEI with over 40 bids selling for over $400... this is very encouraging. Only difference is that one is Unlocked and the seller said he already verified it does work with AT&T with some minor APN changes. Does this seem legit? If so, what is the best/cheapest/most reliable way for me to unlock my phone? I did research this, but it sounds like many online sites charge a pretty good fee for this and don't have the best reputation. Also, most recommended having your carrier do it, which I'm sure is not an option in my case..... Appreciate the support!

I wont suggest you listing it as a phone working on at&t because this phone would not work in usa after a certain period(when tmobile UPDATES their blacklist with other networks) , if the ebay seller advises as such he would face the consequences . Payments are mostly done through paypal and they give a 45 day window for the buyer to claim the phone as not described . That would put you again in the same situation you are today in . You not just sell it for parts ? Get your money out of this sh*t and get yourself a new phone?
