i have been terminated by sprint for allegedly being a data hog. fine by me, as far as i know i did torrent a handful of times and i guess thats what did me in, that and netflix i gather.
had anyone been in this situation before? if so, will my photon have a bad esn? and lastly, i did give sprint a deposit, did anyone get that backbin its entirety?

the torrenting is what did you in my friend, i had a "test" month this month and manage to scrounge up about 6-7GB with nothing happening but this is all from youtube, google music, and large games downloads (nova 3)...and the deposit, well your suppose to get it back after a year i believe, but if you got terminated before then well....who knows, and lastly you can always just call sprint and ask for an esn check (just say you're buying it on ebay or something)

Since sprint advertises unlimited data, I thought the only way they could terminate you (per the contract) is if:
1. excessive data roaming
2. tethering and not paying for that
3. being caught doing something illegal
Unless they can show that they terminated with cause (in writing per the contract you agreed to), than you should get your deposit back with no ETF.

How much data did you use? I'm trying to get them to cancel me without having to pay an etf. I've used about 50 gigs already, but I think the problem with that is I have my phone torrenting while I sleep. I checked Sprint terms of service, they don't consider you an issue if you're not impacting other cusomters use of the service. I don't know how to become an issue through the day since I get crap service at work. (10-15 Kbps. BS)
moxiot, what was your data usage like. Sprint does have a redflag limit and last time I checked it was about 30GB.

the highlighted text is BS in my opinion, but can be used to justify getting rid of you for any reason. That being said, (depending on where you signed up with sprint) you likely signed a service agreement for a plan and not specifically their Terms and conditions. Torrenting is not officially prohibited, and Sprint does not make clear how much data usage on an unlimited plan is prohibited. You should be able to get your deposit back with no ETF fees, and phones with clear ESN's.

all in all im ok with it, as long as they return my deposit, which they said they will. mmmmm galaxy note on tmo coming soon??? yeah, take care sprint...

I question if torrents really had anything to do with it. A while back someone got terminated for using 90 gigs in 3 months. If you used 20+ for months on end, that could easily be the reason. Also, there are a lot of legal torrent uses, so I would hope they wouldn't just terminate everyone that uses one. As an example, Joker uses torrents as an alternate way to download his custom ROMs.
Did they warn you before terminating? It seems like they should have just told you that you are being excessive.
yes they warned me and after that i think i torrented one or 2 things.
I wouldnt be surprised if uploading (seeding) had more to do with it than the downloading.
I wouldn't even be able to be terminated if I tried. My download speeds over EvDo around my house suck. We're talking like 15kb/s max. The only place I get reasonably good speeds is in my dorm room, which is on the 17th story probably a mile (roughly) away from a tower.
Thanks for answering my question, guess I'll just have to persist for a few more months. I don't need a ton of data and I very rarely make phone calls. I'll be switching to T-Mobile's $30 a month plan. When I'm really using data on my phone I'm just messing with RSS, Gmail and a few sub-groups on social sites. My data use was consistently under 1.4 gigs until I got tired of waiting for m feeds and other stuff to load.
My usage may come close to doubling on another network but it will be worth it to actually get data service when I want it. If I need to, I'll jump to T-Mobiles $50 plan. I'm not even greedy, I just want speed that doesn't drop below 400 Kbps very often where I work and in transit to and from it. Most of the Sprint users in my area that I knew said that service was awesome but the phones sucked. I had to find out the hard way that I was speaking to people that didn't know the difference between a software/hardware bottleneck and network bottleneck.
I don't even hate Sprint, but I wish that there was a better method to check average download speed (outside, uninhibited) in an area without jumping onto the service. This goes for any provider.

Actually, yes. It doesn't matter if most torrents are illegal content as the burden of proof lies with the service provider. Therefore the premise of "if he was torrenting that it must have been something illegal" is flawed.
The same flawed thinking also applies to rooting/unlocking. It's the popular mindset of carriers/mainstream news and general pubic that the any reason someone would root their phone is free tethering or some other illegal activity.
Now if the OP was torrenting illegal content then that's his mistake. But at no point did the OP state that he was doing so.

I won't say it'll never happen.. But, the unlimited data is one of the few perks that brings in/keeps customers for Sprint. I haven't been treated badly by Sprint, but I've got no reason to remain loyal for loyalty's sake.
I doubt they will. Over time most data will become wireless anyway. Once all is on 4G or LTE, it won't matter the bandwidth as much. Sprint already charges more for premium data anyway. Not to mention their voice coverage sucks and the unlimited plan is what helps them keep customers. I would switch to Verizon as soon as Sprint says the unlimited plan is changing.

I Don't know alot about it but is there really a differance between using Pandora,Netflix,dishnetwork,ect..... on my tethered gtablet compared to directly on my phone. Not sure......But it does enables me and my kids to enjoy this entertanment in the car without totaly tieing up my phone....Thats just my opion

100% agree on all fronts.
Their CS is fantastic, bar none...but without truly unlimited data I no longer give a **** about that. If I have to pick between the big 3.....AT&T would have the fastest 3G and most pervasive 4G...Verizon would have the best "all around" pricing and fastest 4G and Sprint would have....what? The worst coverage AND crappy plans but pleasant customer service? No thanks. I'll take verizon.
...I hate AT&T with a passion. I have them for home internet service. I have never in my life been treated so poorly by a service I pay for....paying a bill over the phone or online is a gigantic pain in the ass...and I have never ever had a service shut off for paying a service IN FULL, EARLY until I had the modern-day incarnation of AT&T....and I am far from alone on that.
This is Sprint's ace in the hole...well, that and Google recently buddying up with them....but...lacking unlimited data they have no compelling reason to stick around.

As far as data usage, not really. However, it increases the potential for additional/more data usage as you might not of loaded it on your phone if that was the only option.
Personally, any reasonable usage is fine. Big difference between checking email on a tethered laptop.. and torrenting.

This pretty much describes my tethering usage, except the kids part.
I like the leaked plans from AT&T for their LTE pricing. This is based off of what Lulsec stole today, but apparently AT&T is going to go with speed tiers when their LTE is released instead of bandwidth caps, you just pay for how fast you want your internet. To me that makes more sense.

Yeah, umm, unless that torrent download is an absolute emergency (and I actually have been in that situation before...on the road at a trade show....needed a kinda huge file I had hosted at home....) you are just torrenting tethered off your phone to show off...even 4G sucks relative to even a basic cable-modem connection.....
I think the people who use 10+gb a month tethering illegally should take a step back and think about what they're doing. Just pay the price every month to tether the right way. Because once you guys really piss Sprint off, that 20gb you use every month is going to cost a fortune thanks to the tiered data policy they will enact. Then you'll be paying MORE than you would have if you had paid for the tethering.

So I've read individuals were able to get out of contract b/c of changing their PRL profiles. I would like to do this and I wanted to ask a few questions...
1. What is the best PRL files since I read if you put it at 0001 someone had $700 bill. I would like to avoid that.
2. How does this usually take to get flagged + dropped from Sprint?
3. Do they give you a time frame to port your number out?
4. I am on a Family plan is it just my line or everyone on it can get out since if they cancel my line and the bill is under my name.
Also any feedback in getting out of Sprint please advise.

You can't get a bill with roaming charges. Sprint advertises no roaming so they will have to eat the cost themselves. Just use the verizon prl and let them contact you.

I don't mind. There are a couple of reasons actually. Initially, I signed up to Sprint for the low rates which were very good. So I decided to put my entire family on. I was paying under 200.00 for 5 lines on everything plan. Now I pay close to 250.00 which is absurd since I don't use that much service on my phones. We never go over. Sprint will not help me out since 2 of 5 individuals on my plan does not even use data or text and very minimal minutes. So I would like to get out to allocate individuals on smart phone and other that are not to reduce my monthly expenses.
Secondly, I do not get service in my building and in the near future I would like to have service since I expect real sensitive personal calls which I do not want them to call my office line. Sprint allow me to get a free upgrade b/c of a corporate discount change. So I took the upgrade assuming it would help my service in my building it still has not been corrected.
TLDR: Lower my monthly expensive and would like service at my building.

Ummmm.... Simply put no the correct answer to get out of the contract would be to pay the etf and move on, or be patient and let your contract end, let's say worse case scenario you rack up a $700 phone bill or something and you have to pay it, wouldn't it be a brighter idea to just use that money to cancel your contract or a couple of lines?

If I use PDAnet on my i777 will I get immediately flagged for tethering?
I know that AT&T has advanced detection schemes to analyze data patterns, but I don't plan on using PDAnet for tethering very often at all - only when I'm stuck somewhere on the road where there's no other option. The amount of data that I would use would not in itself be anywhere near enough to trigger any kind of high-use detection scheme.

Yes, Att can see when you even Tether even 1kb. Att unjustly monitors your actions to make sure you are not tethering (its not illegal to tether) Ive checked over their terms and agreements and there is nothing in there that we agree to to allow att to monitor us like that. Sadly there is no law against corporations spying on people so this is allowed in America. Wonderful country we live in right?

Att has every right to control what you do on their network, especially when you have the ability to detract from the experience of others by using excessive bandwidth.

I've never received a tos even after requesting one. When I got my data plan tethering and the iPhone did not exist so now what?
If you think occupy is a joke you either have no clue what this is about, are rich, or just plain blind.

Okay, back to the topic at hand, tethering. You risk identification every time you tether. If caught, because you have violated your terms, you will pay. Don't be ignorant enough to think that failure to read your terms means you are not liable. For example if you had an iPhone in the past you agreed twice to not tether, once in iTunes to activate your phone, and again on the phone itself. Att only give your one warning. If you stop tethering you're fine. If not you will permanently lose unlimited data if you have it.
There are plenty of ways to tether. If you root your phone you can use the built in tethering very easily. Regardless of how you tether, if you don't pay for it, it's at your own risk.

I think they also check on the BROWSER type... So if IE is detected, that *might* present a problem more than the sporadic use...

There's no "if you get caught" in computers. They monitor for specific signatures, they see each and every one each and every time. They also surely monitor data usage. Given that they've never sent me a cease and desist, and I've been tethering since EDGE was the fastest network (though I'm not a heavy user by any definition), tethering by itself would not appear to be their primary concern. I think AT&T cares more about how much data you use. They take action against users who consistently degrade network performance, regardless of how the user is doing it...
I received a call today from ATT (missed the call and it went to voicemail) about the online FCC COMPLAINT about the UNLIMITED data plan and throttling issues. If anyone else has received a call would you mind sharing your interactions with ATT on the matter? I will update further any information once I call them back tomorrow morning/afternoon. I ha e to say I am surprised on getting the call so soon since I made the complaint just over a week or two ago. So any info for those that also received the call back please let me know. Thanks

I thought it was from a post on here bit I couldnt refind the post. But there was a link to fcc to make a complaint. I filled it out with the needed info. I will be calling the ATT executive branch or whatever it was that called me today so I will posy whatever info i get from that.

I already have the grandfathered unlimited data plan. I have had it for many years and now they start throttling me. Plus ATT Office of tbe President contacted me about the fcc filing, I did not contact them.
It would be one thing to throttle me at anything above 4Gb per month since they still have a plan with 2Gb data and 2Gb tethering combined for the total of 4Gb per month. I pay and have paid the $30 month to keep my unlimited.I also have two other lines that have the 2Gb per month plans which is $25 month for those two other lines.. If those 2Gb plans go over it automatically starts charging overage charges up to another Gb of Data. But Unlimited really should be unlimited per definition.
But being throttled at 2Gb to the point of .14Mb/s is basically turning OFF the data usage. If it was throttled down to lower speeds than the 8-10Mb/s I get when i am not throttled down to maybe the 1-2Mbs that my captivate gets when it is on 3G speeds may be acceptable, just not .14Mb/s. TOTALLY UNACCEPTABLE.
I usually only used 2-4Gb Data per month and do not tether. So i as others have done said enougb is enough and filed the complaint as others too have.

There is definitely a point where at&t could rationalize throttling us 'unlimited' users, but in my opinion, 2GB is a rediculous limit. The 'unlimited' plan always had a soft cap of 5GB(ish), and I think that should be the point at which throttling occurs. We pay more than the majority of smartphone users, and while I can't speak for others, the majority of the time I come in well below 2GB. What about the 5 years of unlimited data i've been paying for?
All that money I threw away by not using all my data, and now they're gonna throttle people at some arbitrary number between 2-4GB?? It's insane. It didn't really bother me to find out that people averaging 10GB per month were getting throttled, but under 5GB?? NO WAY! When I signed up for unlimited data I understood that after 5GB I would start getting into trouble, but to think that i've been paying $30/month per line for five years, and now i'm gonna get throttled at 2-3GB. UNACCEPTABLE. As soon as some info is released i'm gonna be all over this.

I do not use a lot of data either but I did keep my unlimited plan. I do not like the stance that AT&T has taken. I get that it costs a lot of money to provide the capacity and bandwidth that we want but the fact that no criteria for getting lumped in the top 5% have been provided is ridiculous.
I don't have unlimited but would love it but not with all of AT&Ts crap. I mean the simple term Unlimited implies "no limits"

The thing that bothers me is that when I signed up for AT&T, I was pressured into getting the unlimited plan, which at the time meant that you could use up to 5GB. I realize that bandwidth is scarce in this day and age, but if they were planning on limiting us to 2 or 3 GB they should never had told us we were 'grandfathered' into our plans. At the very least they need to set a specific range for this 'top 5 percent' BS
I am probably not going to be liked for posting this, but I think that throttling should be based on how much network traffic they currently have, so for example in New York City, you will be throttled like crazy most of the time which is unfortunate but necessary, but in a rural area, throttling will most likely never happen, also at night, throttling would be rare too. I know this is an impractical idea, but if they're going to throttle, then this would make the MOST sense, because why would they need to throttle you if you're not slowing their network down, it just doesn't make any sense to me.

so for someone who has tiered plan can run max speed up to however many GB every month (just gotta pay for the overage but you dont get throttled) while unlimited data user gets throttled to almost a halt after 2gb?
does that make sense?

I received the call back from The Office of The President and spoke to him about my fcc complaint. We spoke about how low the throttling is (.14Mb/s) and he said it shouldnt be that low from what he understands. It is only suppose to throttle low enough that streaming video and other streaming wont work properly. I let hom know that i hadn't streamed anything during the last month like netflix or any other streaming. I let him know that the BIGGEST things i have done data wise was i have to download files that are usually 100-300Mb occasionally for work. He said he couldnt remove the throttle for this month but is gonna dig deeper into things to make sure there wasnt any outages in my area and such which would explain the LOW .14Mb/s download speeds. I told him I usually( when not throttled) get at minimum 2-4Mb/s and near my work get 6-10Mb/s download speeds, so dropping down to .14 is plain unacceptable. He is going to look into these tjings and get back with me either by the end of this week or early next week. He also made sure i had his phone number to reach him back. So i will again update once I have more information.
ALSO if you aren"t on a UNLIMITED grandfathered plan and think THIS WONT HAPPEN TO ME. look at how ATT is now going to change rates for their plans now. It says you cn keep your plans or upgrade if you want. That is EXACTLY how it was for us with UNLIMITED data plans. So one day/someday ATT will make some changes that WILL effect you also and MAKE you pay the higher prices. Yeah, the current system of throttling is simply unusable. It's essentially the equivalent to completely disabling data.
How did you actually fill out that form? I want to file a complaint too. The fact that my data usage is continually falling and I'm getting put in this mythical 5% of users category. I wish there was some weirdo hippie way to occupy att by getting everyone to stream media for a weeks time.

Yeah I'm not that stupid. The forms don't really deal with exactly what our complaints are since att no longer advertises nor offers unlimited plans but that's the only choice that makes sense according to the form which is why I asked.

I don't really feel sorry for those who use 100+ GB/month. Those are the users that prompted the removal of the unlimited plans to start with. You can scream "unlimited is unlimited" if you want but its Verizon's sandbox and they make the rules.

Agreed...there comes a point (about 100 GB a month) where it becomes an "unjust enrichment" for the end user....and this is why we cannot have nice things lol
I'm surprised Verizon didn't go the route of...well the unlimited data plan started in the days of 2G/3G only...so that's the only unlimited data you get...when you are on 2G/3G.

I live out in the boonies, I am on 1x and sometimes 3g. my internet is only dsl at 2.5Mbps (3g speeds) ... so whenever I hit 4g on my phone, I do everything with it. so i sometimes rack up 70gb+ a month. especially when im at work ..teamviewer, netflix, streaming cameras setup at various locations, music is always going, showbox, kodi (tends to use a lot more data than other streaming apps)... the data rack up quick.

I use it as primary internet. Been paying for it for so long. Screw paying $60+ a month for cable that is the same speed but doesn't offer the same capabilities that cellular data does. I rack up over 100gb a month but it's a business account so i doubt they will cut me off.
The fcc does nothing about the internet monopoly in my area because it's not considered a monopoly because wireless internet is considered an option. When verizon charges what they do for internet it clearly isn't an option. We all know verizon can afford to give you more GB's at a lower price.
Most of the infrastructure is already in place and they are paying purely for maintenance at this point. And when they are talking about faster speeds with xlte and lte-a they are expecting you to use more data but have no plans on reducing the cost per gb. Faster speeds means a larger resource pool to tap into. The excuse that heavy udp users are decreasing the speeds for others is basically a thing of the past at this point.
Honestly it's all bs marketing and political manipulation. Tell me why countries in the EU can offer unlimited lte data for 35 euoros a month, which people use as their primary internet source, if this isn't the case?

Unjust= people like me or in my "group" pay more in taxes than the "wealthy." Maybe on average.. Some months around 500 and others 100. Feb 17th I say "GOOD<--->BYE" to VZW (they terminate unless I select a plan) after 10 f*$#ing years... not too sure what I'm going to do yet but obviously I cannot afford to stay with VZW..

I average 12GB/month (which is NOT heavy use at all) and received my letter informing my UDP is being terminated as of Feb 16. I have complained to both of my local stores and the customer service call center to no avail. I was told that once the letter was sent my fate was sealed.

They will regret it, T-Mobiles service, at least here is so spotty its not even worth paying for. When my wife had it she had to use my wifi tethering just to use her phone half the time we went anywhere.

But unlimited should be unlimited, i understand that too, but 500gb people... Come on now, that is a little excessive. I don't even come close to that downloading movies all day on my home cable network. So i can see where verizon is coming from. Fair usage.
I am sticking with my Verizon UDP for now, but i have also bought my wife a new phone on at&t's DirecTV unlimited plan that's up to 4 devices just incase verizon pulls out more bs. Figured id jump on that and get grandfathered on that also, since in my area at&t is second best if not identical to Verizon's coverage.
Sprint and T-Mobile are out if the question for me, been there done that.

But unlimited should be unlimited, i understand that too, but 500gb people... Come on now, that is a little excessive. I don't even come close to that downloading movies all day on my home cable network. So i can see where verizon is coming from. Fair usage.

I agree with you on that one, 200GB/month is a bit excessive and almost abusive to the network load. But for those of us that use 12GB and end up getting our plans yanked from us is insulting. I know I purposefully sought out wifi wherever I could to keep unnecessary use of network resources to a minimum. This is the thanks I was given for my consideration.
To say I feel insulted is putting it lightly.

Oh I feel insulted for you as well. 12GB is not that bad at all. I average 45gb and have not received a letter yet. This whole ordeal is ridiculous. I would rather they implement a cap on the unlimited, like say 100GB or even 40GB and then slow us way down instead of just straight up removing us.
