I really wanted to like the S3, but after 8 days with it I'm missing my S2.
The s3 seems really laggy in comparison with the S2. Today I was running copilot together with whatsapp in the background. I went to make a call and the phone phone just grinded to a halt. Together with the dimmer screen and wifi problems I just want to return this and go back to the s2.
Problem with 3 is if you've made a call you've blown the 14 days cooling off. How will they know if I've made a call on it if I restore and wipe the phone? Apart from checking their network logs for IMEI is there any other way for them to know I've used it? I didn't activate the sim either, just cut my old one down.
Any advice?
The sale of goods act overrides three's policies.
If you haven't seen the device in question prior to purchasing it, you've got 7 days in which to send it back. This only applies if you got it online or over the phone and had it sent to you.

Ahh.. I'm I between 7&14 days so the law is not on my side.
How would 3 know if the phone has been used? Is there a call timer they can check?
Hi,
I not understand that you say The s3 seems really laggy in comparison with the S2 - I have both phones and the s3 is far more faster and no lags......
But your questions was about how they can see if you use the phone. There is a internal counter in the phone, I doubt they will check the IMEI connections.
I certainly don't regret buying it because it is an amazing phone but I do wish I waited longer before buying it instead of getting on release day. because I can't save my own words, had to wait for solution to no mass storage mode and transferring Apps to external SD and can't use my old MHL cable and obviously have to wait for custom Roms and kernels, so I kinda wish I waited until next week so I could enjoy my phone more out the box.
Michael,
Its a shame that you feel this way.
I think the S3 is a great phone.
Initially I was not too impressed with the looks of the device due to it rather resembling an iphone 3GS, but once I got it and started playing around with it, it slowly won me over.
Moreover, I think The S3 compared with the S2 is pretty good out of the box standard. Eventhough it does come with bloatware and Samsung customised ICS, both very useable.
I have now just rooted and am running custom ROM and its even better =)
I hope you work out a solution to your problem.
btw - If you were to return the phone, do you intend to take a step back and continue to use the S2? or buy an iPhone 5?
No like I said it is an amazing phone but it is as riddled with early problems that were a big deal for me, and it's been nearly 3 weeks and only just getting the phone running the way I like with a combination of basic Apps and command line, and I ordered a MHL cable that's supposed to be S3 compatible so just gatm to see, so it is only now s can really enjoy the phone for what it is.
Sorry, the post was more meant for OP.
Just installed Omega 5.2 on mine.

Indeed it does but your understanding of the law is wrong. You are entitled to inspect the goods. The Distance Selling Regs (which is what you are actually referring to) do not give you carte blanche to use the phone for a week before returning it.
Three's policy is (broadly) in line with the law.
Stock S3 is faster than stock S2.
Any S3 rom is slower than most custom S2 rom. Just my 2c...Although I still love my S3.
Flash the original firmware and ur call logs will be gone. Don't think they would check Imei with a phone so new.

What you have to be aware of in the UK a contract phone is not a sale but an inducement to buy the contract .
All you can do is wipe phone remove root and rom count and try to return .
moneysavingexpert forum has a dedicated mobile phone section with guys and gals more clued up on your exact rights in the mobile phone world .

Not if you have used them. The purpose of the legislation is to give you the same opportunity to inspect the goods as you would have in a shop. As I said, it doesn't allow you to use for a week then return, even if some co's let you do that.

"Packaging
Under a distance selling contract, a supplier cannot make refunds subject to the goods being returned unopened in their original packaging. One of the principles of the distance selling regulations is to give you a chance to examine the goods at home, not having had a chance to do so in the shop. It would be impossible for you to do this without opening the packaging and trying the product out. Having said this, you will still be under a duty to take reasonable care of the goods while in your possession, and may be subject to certain instructions such as not to wear shoes outdoors, or remove hygiene seals. But you can never be penalised simply because you did not return the goods in their original packaging."
You obviously can't inspect the goods without opening them and trying them out.

Not sure if anyone has stipulated this but in the UK u can return ur phone within 14 days as long as the phone is "as purchased" with all the gear intact (obviously really) and u have to settle any outstanding costs u may have incurred (calls texts etc). They have to accept and cancel its consumer law (this happened to me 2 weeks ago as it happens I was told this by both ofcom and citizens advice) there is a certain law u can quote but I can't find it (although when I said consumer law they sort of caved)

Opening yes, "trying out" perhaps. Putting your SIM in and using for a week, no. You couldn't do that in a shop could you? Anyway, the networks rely on the fact that you are also purchasing a contract for services, and they are legally entitled to say that once you use the SIM, you are accepting the contract and waiving distance selling protections. So even if you could return the phone, you'd be stuck with the contract. The law on the subject is a lot more complex than people think.

Well, Ordered my new samsung Galaxy S3 and waiting for it to come to me, but like many of you, since its my first 600+ investment on a Smartphone with no warranty in US, wanted to ask your views over is it really worth getting a warranty.
I have checked Squaretrade, and they informed me since Samsung US is not providing warranty over it, they will also not be providing any warranty on it.
Then I found this firm over internet, Ensquared, I talked to them and they said that they will be providing the warranty for this phone. Their deal looks too sweet to me, as replacing it with a brand new phone, world wide coverage is something too good to digest.
But havent heard of them much and dont know if it is good and reliable to get a warranty from them. Do you think is it worth taking it from them?

All this is not completely true. As long as you purchase your I9300 from an American store, and like Negri or Expanses USA then you can get a warranty and you already have a 1 year warranty. Expanses or Negri acts as the middleman for your warranty purposes and square and trade would work with them.

Ensquared is fine. They were the only ones to cover the Galaxy Nexus in the US when it first came out.
Unless like said above, you go through Negri or Expansys.

I purchased it from Amazon US, Not by Expanses or Negri, They say that the warranty is applicable in country of Origion which is Korea and Hongkong ...
I'm currently in the US (Orlando, FL) - and I was thinking about buying and S3 since its half the price compared to where I live.
What's bothering me is, I'm searching though Amazon and I found phones like this one - it's advertised as Unlocked but the highest rated comment says
The phone is wonderful, but this is not the right phone they advertise. It is the AT&T US version SGH-I747

Is there any seller on Amazon which you guys know that is guaranteed unlocked and ships fast?
My opinion is not to buy it from Amazon or similar. Best to go into a store or buy it off someone upfront. Its a hassle if something goes wrong with a purchase from the internet.

not true, Amazon's service is amazing
The point to be aware buying a I9300 and residing in the USA is you will not get warranty in the USA . Requirement will be to send it back to the country of origin .See multiple posts from USA users on the subject on XDA .

Ebay is a virtual platform where anyone can offer his goods and other people buy it with virtually no verification.
Amazon on the other hand has huge warehouses, so yeah there is a difference - unless you buy through Marketplace.

Hello xda. A few weeks ago I sold my S3 for $200 and purchased a used silver AT&T HTC one for $450 from an electronics reseller here in OKC, Cdr electronics. I'm outside of my upgrade window and really wanted the One so i figured this was the best and least expensive route. The phone was in almost mint condition. Not a single flaw except the common gap on the speaker grills. I didn't get any packaging or accessories, just the phone itself.
Now about 3 weeks later I've noticed dust and lint under the glass about half an inch in from the volume rocker and it's really starting to bug me. Obviously it's a hardware defect, but I don't have the original receipt, only mine from the reseller. Is their anything i can do? I can return it for a full refund in the next week but I'm curious if there is any warranty at all i can utilize. Would AT&T do anything for me? HTC? Anyone else in this situation? Thanks!

Since you didn't get the phone from AT&T, I doubt they will give you anything on warranty. HTC warrants the phone for one year from purchase or 15 months from manufacture. The serial number of the phone identifies the manufacture date. If you call HTC, I wouldn't tell them any information they don't ask for. Also, if you send it back to HTC, make sure it is in full stock form. No unlocked boot loader and stock Rom. Remove all evidence of tampering with the device or they will deny warranty.

What kind of warranty did the business give you on purchasing it from them? If it's a shop worth their salt, it's at least 30 days. Can you take it up with them? If not, I would call HTC and talk to them about it. Just as dborgo states, don't mention that it was used and you should be fine. One user on here got caught up by volunteering info he shouldn't have and it cost him money for repairs. Simple Yes or No answers with a few vague responses SHOULD get you what you want.

I bought a One off CL and contacted att when I found a defect with the back camera. They sent me a new one with no issues. They had even asked where I purchased the phone and I told them off of a third party. I used the online chat. If you don't get the answer you want on the first call/chat just hang up and contact them right back. You will get through to a person who is helpful. Good luck

The official HTC Warranty
I took a picture of the warranty card that came with my One, since HTC's website is quite obtuse and the info was impossible to find. Basically, the HTC warranty goes to the original purchaser and is not transferable to a third party. That isn't to say that they won't work something out with you, but you should also be prepared to pay for the repairs if they find out.

I would guess your best bet is to go through AT&T. They are pretty good about warranties on the devices they sell. If they show your line using a ONE it shouldn't be a problem. If asked where it was purchased just tell them it was a 3rd party wireless retailer. Worst case scenario, I'm sure HTC will fix it for you but more than likely they will charge you at least 100 bucks. At that point you mine as well return it and buy a new one directly from HTC.

Hi guys,
I'm looking for a cheap deal for the phone for Christmas. After checking the usual mobile network deals I'm not convinced to pay £38/ month for 2 years.
Instead I saw new phones on ebay for £370 from a trusted seller.
Phones come from "outside UK" warehouse(I'm located in the UK) with 2 pin plug. I wonder if these are dodgy deals, or worth trying it?
The seller itself is providing the warranty for one year and they have very good feedback.
Here is one : LINK
I simply could not find a cheaper one around. DO you think I could go ahead with the buy?

Hmmm, I'm probably in the minority here but I'd beware. Their shipping them in from China and for that price I wouldn't be at all surprised if they're clones. They do have good feedback, but I just don't see how they could possibly sell the real article that cheap without it being dodgy. My guess is if you were able to get it on a network, it would get locked soon after. The other reason I think it's unsafe is that the warranty is with themselves, not an official Sony warranty, which basically means there isn't one.
I'd steer clear.

Thanks for the feedback, that's what I'm looking for.
I'm about 50-50% and I need some more either negative or positive feedback about it to decide.
The problem is that the next phone up on ebay is £419 which is quite high :S
I want to stay on 3 network, so most online phone shops(carphone, mobiles, etc) is out
